Explanation
 
Background:  This legislation authorizes the Public Service Director to enter into a contract in an amount up to $661,250.00 for the UIRF Traffic Calming 2003 project with Decker Construction for the Transportation Division, and to pay construction inspection costs up to $94,803.00.  This improvement details the construction of traffic calming devices in various locations citywide and includes 14' speed humps, 22' speed humps, intersection speed humps and other associated work.  This project is part of the Urban Infrastructure Recovery Fund and has been requested by various neighborhood and area associations.  The Notice to Proceed is estimated at August 14, 2003.  The completion date is estimated at 120 days.  This project was advertised in The Columbus City Bulletin, Dodge Reports and was let by the Transportation Division.  Five bidders/suppliers were solicited (4 majority, 1 minority) and two bids were received (2 majority, 0 minority) and tabulated on June 19, 2003 as follows:
 
Decker Construction Company         $ 661,250.00
Strawser Paving Company                 $ 667,747.50
 
Award is to be made to Decker Construction Company, CC No. 31-0983557 (expiring 08/14/2003), as the lowest, best, most responsive, and most responsible bidder.
Emergency action is requested for the immediate execution of the contract for the earliest possible start of construction so that the improvement may be substantially completed in 2003.
 
Fiscal Impact:  Funds are budgeted for the UIRF Traffic Calming 2003 project  in the Voted 1995, Voted 1999 Streets and Highways Fund.

To authorize the Public Service Director to enter into a contract with Decker Construction Company for construction of the UIRF Traffic Calming 2003 project, to authorize the expenditure of $756,053.00 from the Voted 1995, Voted 1999 Streets and Highways Fund for the Transportation Division, and to declare an emergency. ($756,053.00)
 
Body
 
WHEREAS,  bids were received and tabulated on June 19, 2003, for the UIRF Traffic Calming 2003 project; and
 
WHEREAS,  a satisfactory bid has been received; and
 
WHEREAS,  it is necessary to provide for construction inspection costs; and
 
WHEREAS, the low bid received was satisfactory as it pertains to the Responsible Contractor requirements; and
 
WHEREAS,  an emergency exists in the usual daily operation of the Transportation Division, Public Service Department, in that the contract should be let immediately so that the work may proceed without delay, thereby preserving the public health, peace, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Public Service Director be and is hereby authorized to enter into a contract with Decker Construction Company, 3040 McKinley Avenue, Columbus, Ohio 43204, for the construction of the UIRF Traffic Calming 2003 Project in the amount of $661,250.00 for the Transportation Division in accordance with the specifications and plans on file in the office of the Public Service Director, which are hereby approved; to obtain and pay for the necessary inspection costs associated with the project up to a maximum of $94,803.00.
 
SECTION 2.  That for the purpose of paying the cost of the contract and inspection, the sum of $756,053.00, or so much thereof as may be needed, is hereby authorized to be expended from 1995, 1999 Voted Streets and Highways Fund, No. 704, for the Transportation Division, Dept./Div. 59-09, OCA Code 644385, Object Level Three 6631 and Project 440005.
 
SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
