APPLICANT:  Ailsa Property Group, LLC; c/o Donald T. Plank, Atty.; 145 East Rich Street; Columbus, Ohio 43215.
 
PROPOSED USE:  Unspecified commercial development.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (6-0) on November 13, 2003.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The requested rezoning to the CPD, Commercial Planned Development District to add additional permitted uses and for a four-space parking reduction is consistent with the surrounding zoning and land uses.  The proposed CPD, Commercial Planned Development District contains development standards that will ensure consistency with the surrounding zoning and land use patterns of the area.  The Transportation Division supports the four space parking reduction and believes that it will have no adverse impact on the surrounding properties.

WHEREAS, application #Z03-115 is on file with the Building Services Division of the Department of Development requesting rezoning of 1.0± acres from L-C-4, Limited Commercial Planned Development District to CPD, Commercial Planned Development District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS,  an emergency exists in the usual daily operation in the City of Columbus in that it is immediately necessary to submit for building permit as tenant leases have been signed and client has to deliver a finished building with Certificate of Occupancy not later than 10/15/2004 thereby making this emergency amendment critical for the immediate preservation of the public peace, property, health and safety; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the requested rezoning to the CPD, Commercial Planned Development District to add additional permitted uses and for a four-space parking reduction is consistent with the surrounding zoning and land uses.  The proposed CPD, Commercial Planned Development District contains development standards that will ensure consistency with the surrounding zoning and land use patterns of the area.  The Transportation Division supports the four space parking reduction and believes that it will have no adverse impact on the surrounding properties, now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
 
6079 BLAZER PARKWAY (43213), being 1.0± acres located at the northwest corner of Blazer Parkway and Tuttle Crossing Boulevard, and being more particularly described as follows:
 
Situated in the state of Ohio, County of Franklin and being lot 11 of Tuttle crossing section 2, plat book 72, page 08, Franklin County, recorder's records:
 
Beginning at the southwest corner of lot 11 of said subdivision;
 
Thence n.10°35'16"w. Following the easterly line of lot 12 of said subdivision, a distance of 287.85 feet to a point;
 
Thence with the following the two (2) courses along the southerly right-of-way line of a Parkcenter circle (60' r/w);
1.      With a curve to the left having a radius of 681.29 feet, a delta of 05°39'36", an arc of 67.30 feet, and a chord bearing of N.74°18'08"E. For a chord distance of 67.27 feet to a point;
2.      N.71°28'20"E;
3.      A distance of 57.87 feet to a point;
 
Thence following the right-of-way line of Parkcenter circle (60' r/w) and Paul Blazer Parkway (100' r/w) with a curve to the right having a radius of 20.00 feet, a delta of 78°13'08", an arc of 27.30 feet, and a chord bearing of S.69°25'06"E. For a distance of 25.23 feet to a point;
 
Thence with the following two (2) courses along the westerly right-of-way line of Paul Blazer Parkway (100' r/w);
1.      With a curve to the right having a radius of 499.36 feet, a delta of 19°43'16", an arc of 171.88 feet, and a chord bearing S.20°26'54"E. For a distance of 171.03 feet to a point;
2.      S.10°35'16"E. A distance of 35.77 feet to a point;
 
Thence with the following three (3) courses along the northwesterly side of reserve "a" of said subdivision;
1.      S.79°24'44"W. A distance of 17.50 feet to a point;
2.      With a curve to the left having a radius of 67.50 feet, a delta of 89°34'35", an arc of 105.53 feet, a chord bearing of S.34°37'18"W. For a chord distance of 95.11 feet to a point;
3.      S.10°35'16"E. A distance of 17.50 feet to a point;
 
Thence S.79°24'44"W. Following the northerly line of Tuttle crossing boulevard (100' r/w), a distance of 90.20 feet to the point of beginning, containing 1.000 acres more or less.
 
This description was based on an actual field survey by the Jerry A. Malott surveying company in December, 2003.
 
Bearings were based on the centerline of Tuttle Crossing Boulevard as being S.79°24'44"W. As shown in p.b. 72, pg. 08.

INTRODUCTION:
       The property is a 1.0 ± parcel of land located at the northwest corner of Tuttle Crossing Boulevard and Paul Blazer Parkway (the "Property"). The Property is zoned L-C-4, per Ordinance No. 2235-91. The Applicant proposes to rezone the property to permit additional retail uses.  
      A plan entitled "CPD Site Plan" dated January 22,2004, (hereinafter referred to as the "Plan") is, hereby incorporated by reference and made part of this rezoning.  
      
PERMITTED USES:  The following uses shall be permitted:
 
Those uses as permitted in Chapter 3355, Community Scale Commercial Development District, (C-3) of the Columbus City Code.
 
 
1.      DEVELOPMENT STANDARDS:
Except as specified herein, or as depicted on the Plan, applicable development standards of Chapter 3355, Community Scale Commercial Development District, shall apply.  
 
A. Density, Height Lot and/or Setback Commitments.
 
1. Density:       N/A
 
2. Height:       Height District shall be H-110
 
3. Lot:       N/A
 
4. Setback:       Parking setback shall be as depicted on the Plan. A minimum-parking setback of thirty (30) feet shall be maintained along Paul Blazer Parkway.
 
B.      Access, Loading, Parking and/or Traffic Related Commitments
1. N/A
 
C. Buffering, Landscaping, Open Space, and/or Screening Commitments.
1.      An open vehicular use area excluding loading, unloading and storage area containing twenty (20) or more vehicular parking spaces shall provide interior landscaping. Interior landscaping may be peninsular or island type. For each 100 square feet or fraction thereof of vehicular use, a minimum total of 5 square feet of landscaped area shall be provided. Landscaped areas shall contain one tree per every ten parking spaces.
2.      Minimum size of all trees shall be 2 to 2½ inch caliber for shade, 6 to 8 feet high for evergreen, and 1 to 1½ inch caliber for ornamental.
3.      Within the setback area along Tuttle Crossing Boulevard and Paul Blazer Parkway, a three (3) foot average height continuous planting hedge, fence, wall, earth mound or combination thereof shall be installed as well as one tree per 40 feet of frontage or fraction thereof. Trees do not have to be equally spaced, but may be grouped.
 
D. Building Design and/or Interior-Exterior Treatment
  Commitments

E.  Dumpsters, Lighting, Outdoor Display Areas and/or Environmental    Commitments
 
1.      All new or relocated utility lines shall be installed underground unless the applicable utility company directs or requires otherwise.
2.      All waste and refuse shall be containerized and fully screened from public view by a solid wall or fence to a minimum height of six (6) feet.
3.      No materials, supplies, equipment or products shall be stored or permitted to remain on any portion of the parcel outside the permitted structure.
4.      Mechanical equipment or other utility hardware on the roof, ground or building shall be screened from public view with materials compatible with the building.
5.      All external light shall be cut off type fixtures and shall not spill any light off the property, except that up lighting may be used to illuminate landscaped areas and buildings.
6.      All types of parking, pedestrian and other exterior lighting shall be on poles or wall mounted cutoff fixtures and shall be the same type and style.
7.      All light poles and standards shall be dark brown, bronze or black in color and shall either be constructed of dark wood or dark brown, black or bronze metal.
8.      Parking lot lighting shall be no higher than 28 feet.
 
 
F. Graphics and Signage Commitments
      
1.      All graphics shall conform to Article 15 of the Columbus Graphics Code, as it applies to the C-3, Community Scale Commercial District. Any variance to the applicable sign requirements of the C-3 district shall be submitted to the Columbus Graphics Commission.
2.      Signage may be internally or externally illuminated.
3.      No roof top graphics shall be permitted.
4.      The height of any free standing graphic shall not exceed twenty (20) feet.  
 
 
G. Other CPD Requirements
1.      Natural Environment: The natural environment is flat.
2.      Existing Land Use: The property is presently developed with an empty building and landscaping.
3.      Circulation: There is no direct access from Tuttle Crossing Boulevard and Paul Blazer Parkway to the site. Vehicular access to and from the site shall be via Park Center Circle.
4.      Visual Form of the Environment: The surrounding area in all directions is commercially zoned and developed.
5.      Visibility: The site fronts on Paul Blazer Parkway.
6.      Proposed Development: Commercial.
7.      Behavior Patterns: The site is located on Paul Blazer Parkway. Vehicular access shall be from Park Center Circle.
8.      Emissions: Development shall conform to City of Columbus requirements as further controlled by development standards of this text for light levels, sounds and dust. There will be no objectionable emissions.
9.      Variances: A reduction of 50 minimum parking spaces to 46 spaces.   
 
 
Miscellaneous
 
1.      The Plan represents the intended development of the site. However, based on final engineering of the site, the applicant may deviate slightly from the Plan upon review and approval of the Director of the Department of Development or his Designee.
2.      The Board of Zoning Adjustment shall hear requests for variances to code and site development standards contained in this ordinance.
 
 
SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or 10 days after its passage if the Mayor neither approves nor vetoes the same.
