Explanation
BACKGROUND:
The City of Columbus Planning Division has been helping to facilitate expansion of the Livingston Avenue Urban Commercial Overlay (UCO). The existing overlay was passed by Council on February 8, 1999 and includes all parcels fronting Livingston Avenue between Lockbourne Road and Fairwood Avenue. The expansion would add select parcels within the Livingston Avenue corridor between Eighteenth Street and Lockbourne Road.
This section of Livingston Avenue contains areas of early and mid-twentieth century commercial development. The overlay is appropriate for these areas because it establishes alternative standards for new development and redevelopment that are consistent with the development patterns and characteristics of older central city commercial corridors. These standards eliminate the requirement for large building setbacks, prescribe architecturally appropriate building elements, require more suitable placement of on-site parking, and allow for a reduction in off-street parking.
The proposed expansion is the result of extensive input and collaboration among a broad base of area stakeholders and community groups. It has received endorsements from the Council of Southside Organizations and the Driving Park Area Commission and has been recommended for Council adoption by the Development Commission.
FISCAL IMPACT:
No funding is required for this legislation.
Title
To supplement the Columbus City Codes, 1959, by amending Chapter 3372.673 to expand the Urban Commercial Overlay along portions of Livingston Avenue.
Body
WHEREAS, when commercial development and redevelopment occurs along urban thoroughfares in older Columbus neighborhoods, the current development standards contained in the Columbus Zoning Code do not easily adapt; and
WHEREAS, the current zoning requirements for large setbacks and the need to accommodate a high ratio of off-street parking adjacent to the thoroughfare or right-of-way has resulted in sporadic and intermittent development that does not easily fit into the original pedestrian-oriented architecture of these older urban corridors; and
WHEREAS, the purpose of the Urban Commercial Overlay is to regulate commercial development in specifically designated areas in order to address the unique characteristics of older, central city commercial areas; and
WHEREAS, after public notice and mailing to all affected property owners and those within 125 feet, a public hearing was held at which the Development Commission recommended that City Council adopt the proposed additions to the Livingston Avenue Urban Commercial Overlay; and now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Columbus City Codes, 1959, are hereby supplemented by adding the following parcels to Chapter 3372.673 (see Exhibit A for map of affected parcels):

Section 2. That the Director of the Department of Development be, and is hereby authorized and directed to make said changes on the said Official Zoning Map for the City of Columbus.
Section 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
