AN03-033
BACKGROUND:      This ordinance is submitted to present to Council the transcript of proceedings and papers relating to Annexation AN03-033 a certain petition for annexation as described in the ordinance and transcript which is attached hereto. More than sixty days have elapsed since November 24, 2003, the date of receipt from the Board of County Commissioners of Franklin County.
 
These are submitted in accordance with the Ohio Revised Code.
 
FISCAL IMPACT:      Provision of municipal services for a proposed annexation area has no fiscal impact.  However, provision of the stated services does represent cost to the city.  The annexation of land also has the potential to create revenue to the city.
 
 
 
 
Title
 
 To accept the application (AN03-033) of Columbus Regional Airport Authority for the annexation of certain territory containing 18.004 ± Acres in Hamilton Township.    
 
 
 
Body
 
 
WHEREAS,   a petition for the annexation of certain territory in Hamilton Township was duly filed by Columbus Regional Airport Authority on October 8, 2003; and
 
WHEREAS,  the said petition was duly considered by the Board of County Commissioners of  Franklin County, Ohio, and the annexation of said hereinafter described territory to the city of Columbus was approved by said Commissioners by order dated November 18, 2003; and
WHEREAS,  the Board of County Commissioners of  Franklin County certified the transcript of the proceedings in connection with the said annexation with the map and petition required in connection therewith to the City Clerk who received the same on November 24, 2003; and
WHEREAS,  sixty days from the date of said filing have now elapsed in accordance with the provisions of the Ohio Revised Code; and
 
WHEREAS,  it is in the best interest of the city of Columbus to accept the annexation of the territory sought to be annexed by the aforesaid petition; now, therefore,  
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
 
Section 1.  That the proposed annexation as applied for in the petition of Columbus Regional Airport Authority being the majority of owner(s) of real estate in the territory sought to be annexed and filed with the Board of County Commissioners of Franklin County, Ohio October 8, 2003 in which said petition prayed for annexation to the city of Columbus, Ohio, of certain territory adjacent thereto as hereinafter described, and which said petition was approved for annexation to the city of Columbus by the Board of County Commissioners by order dated November 18, 2003, be and the same is hereby accepted and said territory is hereby annexed to the city of Columbus.  Said territory is described as follows:
 
Situate in the State of Ohio, County of Franklin, Township of Hamilton, and lying in Section 1, Township 3 North, Range 22 West, Congress Lands and being 18.004 acres of land, more or less, being all of the 8.208 acre tract conveyed to Glenn Wright Development Co. LLC, (Auditor's Tax Parcel 150-002654) of record in Instrument Number 199907290192461, a 6.890 acre tract conveyed to BN Associates, LLC, (Auditor's Tax Parcel 150-002635) of record in Instrument Number 200306040167248, a 0.098 acre tract (well site No. 5) (Auditor's Tax Parcel 150-000084) and 1.167 acres out of Parcel "C" conveyed to Columbus Municipal Airport Authority (Auditor's Tax Parcel 150-002438) of record in 200301020000788, and the remaining portion of Wright Brothers Avenue of record in Plat Book 83, Page 82 not previously annexed, all records herein of the Recorder's Office, Franklin County, Ohio, and said 18.004 acres of land being bounded and more particularly described as follows:
 
      Beginning at an angle point in the existing City of Columbus Corporation Line as established by Ordinance Number 1386-97 of record in Instrument Number 99710070113498, said point being the southwesterly corner of John Glenn Avenue (60 feet in width) of record in Plat Book 76, Page 45 and Wright Brothers Avenue (60 in width) of record in Plat Book 83, Page 82;
 
      Thence South 86° 13' 33" East, a distance of 594.80 feet, along the said existing City of Columbus Corporation Line, a line common to the southerly right-of-way line of said John Glenn Avenue and the northerly line of said 8.208 acre tract, to an angle point in said existing corporation line, said point being the northeasterly corner of said 8.208 acre tract;
 
      Thence South 03° 46' 27" West, a distance of 790.83 feet, continuing along the said existing corporation line, a line common to said 8.208 acre tract and a 14.332 acre tract conveyed to Meridian Industrial Trust, Inc., to an angle point in said existing corporation line, said point being in the southerly right-of-way line of Wright Brothers Avenue (60 feet in width);
 
      Thence South 86° 09' 45" East, a distance of 445.70 feet, continuing along the existing corporation line, a line common with the southerly right-of-way line of said Wright Brothers Avenue and the northerly line of a 6.890 acre tract conveyed to BN Associates, LLC, to an angle point in said existing corporation line, said point being the northeasterly corner of said 6.890 acre tract;
 
      Thence South 03° 50' 15" West, a distance of 525.15 feet, continuing along the said existing corporation line, a line common to the easterly line of said 6.890 and a 4.474 acre tract conveyed to GMPM Properties, Inc., to an angle point in said existing corporation line, said point being in a southerly line of Parcel "C";
 
      Thence North 86° 15' 09" West, a distance of 591.43 feet, along the said Parcel "C" line to a point marking the intersection with the existing City of Columbus Corporation Line as established by Ordinance Number 972-95 of record in Official Record 29162, A-02;
 
      Thence the following three (3) courses and distances along the said existing corporation line, a line common to said Parcel "C" line:
      
1.      North 03° 48' 27" East, a distance of 528.89 feet, to an angle point;
      
2.      North 86° 06' 48" West, a distance of 449.29 feet, to an angle point;
      
3.      North 03° 48' 36" East, a distance of 100.00 feet, to a point at the southeast corner of a 0.098 acre tract (well site No. 5) conveyed to Columbus Municipal Airport Authority;
 
Thence the following three (3) courses and distances along the said 0.098 acre tract (well site No. 5):
 
1.      North 86° 11' 24" West, a distance of 105.00 feet, to a point at the southwest corner;
 
2.      North 03° 48' 36" East, a distance of 40.69 feet, to a point at the northwest corner;
 
3.      South 86° 11' 24" East, a distance of 105.00 feet, to a point at the northeast corner, being in the said existing City of Columbus Corporation Line;
 
Thence North 03° 48' 36" East, a distance of 646.28 feet, along the said existing corporation line, line common to said Parcel "C" line to the Point of Beginning, containing 18.004 acres, more or less, with 1.641 acres being within the right-of-way of Wright Brothers Avenue.
 
Section 2.  That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.
 
Section 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
