Explanation

 

This ordinance is submitted to settle a claim for damages that the City of Columbus incurred during construction of the Blacklick Sanitary Interceptor Project.  URS Engineering was hired by the Department of Public Utilites, Division of Sewers and Drains to design sewer lines associated with the  Blacklick Sanitary Interceptor Augmentation Project.  The sewer did not function appropriately.  The City was forced to expend funds to correct the problem.  URS subsequently accepted another contract with the City for work on the Big Walnut Interceptor Project (BWARI)  and URS has proposed to allow the City  to deduct $60,000.00 from the amount theCity owes URS for its work on the BWARI Project.  This amount would be deducted, $10,000.00 at a time, from the monthly invoices URS submits to the City for the BWARI  project.

 

Fiscal Impact:  A credit of $60,000.00 to the BWARI Project accounts.

To authorize and direct the Public Utilites Director to accept a settlement arrangement with URS Engineering which would return  $60,000.00 to the City, and to declare an emergency. ($60,000.00)

 

 

Body

 

WHEREAS,  URS recognizes a debt to the City of Columbus, Department of Public Utilities for damages incurred during sewer construction; and

 

WHEREAS, URS has offered to pay the City for its damages incurred by allowing the City to deduct a total of $60,000.00 from amounts the City currently owes URS on a another project; and

 

WHEREAS, an emergency exists in the usual daily operation of the City in that it is necessary and desireable to begin the repayment process as soon as possible, now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

Section 1.  That the Public Utilities Director is hereby authorized and directed to enter into a settlement arrangement with URS Engineering to facilitate the return of $60,000.00 to the City of Columbus by way of deducting said amount from amounts that are currently owed by the City to URS.

 

Section 2.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayour neither approves nor vetoes the same.
