Explanation
Article 38, Section 38.4 of the collective bargaining agreement with the Fraternal Order of Police, Capital City Lodge No. 9 ("FOP") and the City of Columbus, December 9, 2020 through December 8, 2023, requires that any modifications to the collective bargaining agreement be agreed to by the parties. Memorandum of Understanding #2023-05 grants full time members Paid Family Leave, an up to twelve week fully compensated benefit for the birth of a child, placement of a child for adoption or foster care, and to care for a covered family member with a serious health condition. Paid Family Leave will be effective November 12, 2023, the beginning of the pay period that includes Council's acceptance of Memorandum of Understanding #2023-05. The passage of this ordinance indicates City Council’s acceptance of Memorandum of Understanding #2023-05, a copy of which is attached hereto.
Emergency action is recommended in order to allow for expedient implementation in accordance with the terms of the agreement.

To accept Memorandum of Understanding #2023-05 executed between representatives of the City of Columbus and with the FOP that grants full time members Paid Family Leave, an up to twelve week fully compensated benefit, for the birth of a child, placement of a child for adoption or foster care, and to care for a covered family member with a serious health condition; and to declare an emergency.

WHEREAS, representatives of the City of Columbus and the FOP, entered into Memorandum of Understanding #2023-05, a copy of which is attached hereto, which grants full time members Paid Family Leave, an up to twelve week fully compensated benefit for the birth of a child, placement of a child for adoption or foster care, and to care for a covered family member with a serious health condition; and
WHEREAS, emergency action is recommended in order to implement the terms of the Memorandum of Understanding in a timely manner; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Human Resources in that it is immediately necessary to amend the collective bargaining agreement between the City and the FOP by accepting Memorandum of Understanding #2023-05 to effectuate the timely negotiated clauses and ensure Paid Family Leave coverage is in place for those members of the FOP who may be eligible for the benefits described in said Memorandum of Understanding, all for the immediate preservation of the public peace, property, health, safety and welfare; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That Memorandum of Understanding #2023-05, amends the collective bargaining agreement between the FOP and the City of Columbus, December 9, 2020 through December 8, 2023.
SECTION 2. That City Council, in the best interests of the City, hereby, recognizes and accepts Memorandum of Understanding #2023-05 executed between representatives of the City and the FOP, a copy of which is attached hereto and incorporated herein by reference.
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure, and shall take effect and be in force from and after its passage and approval by the Mayor, or ten (10) days after passage if the Mayor neither approves nor vetoes the same.
