Title: To authorize the Director of the Department of Public Utilities to execute those documents necessary to grant the State Of Ohio, Department of Administrative Services, Multi-Agency Radio Communication System Office, separate licenses for the shared utilization of two City owned communications towers for the purposes of operating a multi-state agency mobile radio system, and to declare an emergency.
Explanation
 
Background: The City of Columbus, Ohio (the "City") is owner of certain communications tower sites, which are located on those City properties known as the Morse Road Water Treatment Plant and The Parsons Avenue Water Treatment Plant respectively.  The State Of Ohio, Department of Administrative Services, Multi-Agency Radio Communication System Office, ("MARCS") desires to utilize the two separate City owned communications towers for the purpose of operating a mobile radio system.  This system allows radio communication among and between several State agencies, including the Ohio State Highway Patrol.  MARCS desires to access certain portion of the two premises for the installation of certain communication equipment necessary to its operation.  After investigation, it has been determined that granting MARCS the use of the tower sites will not adversely effect the City.  The following ordinance authorizes the Director of the Department of Public Utilities to execute those separate documents necessary to grant the State Of Ohio, Department of Administrative Services licenses for use of the aforementioned communication tower sites.
 
Fiscal Impact: Any revenues generated by this transaction and received by the City in the appropriate fund as set forth in the body of this legislation.
 
Emergency Justification:  Emergency action is requested to allow for the City's immediate collection of revenues generated from the granting of the subject license agreements.

Body
 
WHEREAS,      the City of Columbus, Ohio (the "City") is owner of certain communications tower sites, which are located on those City properties known as the Morse Road Water Treatment Plant and The Parsons Avenue Water Treatment Plant respectively; and
 
WHEREAS,      the State Of Ohio, Department of Administrative Services, Multi-Agency Radio Communication System Office, ("MARCS") desires to utilize the aforementioned City owned communications towers for the purpose of operating a mobile radio system; and
 
WHEREAS,      this system allows radio communication among and between several State agencies, including the Ohio State Highway Patrol; and
 
WHEREAS,      MARCS desires to access a certain portion of the two premises for the installation of communication equipment necessary to its operations; and
 
WHEREAS,      after investigation, it has been determined that granting MARCS the use of the tower sites will not adversely effect the City; and
 
WHEREAS,      revenue collected from MARCS will be deposited in the proper fund as approved by the City Auditor; and
 
WHEREAS,      an emergency exists in the usual daily operation of the City of Columbus, in that it is immediately necessary to authorize the Director of the Department of Public Utilities to execute those documents necessary to grant a license agreement to the State Of Ohio, Department of Administrative Services, Multi-Agency Radio Communication System Office for the immediate preservation of the public peace, property, health and safety; now, therefore:
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
      Section 1.      That the Director of the Department of Public Utilities, be and hereby is authorized to execute those documents, as approved by the Real Estate Division, Department of Law, necessary to enter into a License Agreement between the City, and the State of Ohio, Department of Administrative Services, Multi-Agency Radio Communication System Office to provide capacity and shared utilization of the City owned communication tower sites located at the Morse Road Water Treatment Plant and the Parsons Avenue Water Treatment Plant, respectively.
 
Section 2.      That the City Auditor, be and hereby is authorized and directed to deposit any revenues generated by this transaction and received by the City in the appropriate fund.
 
      Section 3.      That for the reasons state in the preamble hereto, which is hereby made a part hereof, be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
