Explanation

 

Background: This ordinance authorizes the Director of Public Utilities to renew an existing agreement with Johnson Controls Fire Protection LP, formerly SimplexGrinnell LP, for life safety system maintenance services. The contract amount being authorized by this ordinance is $143,108.03.

 

This contract, also known as FEM 1390.3, will provide for inspections, diagnostic tests and repairs for all accessible peripheral devices currently connected to the life safety systems.

 

There is a need for inspections and diagnostic tests for all accessible peripheral devices currently connected to the fire protection systems. These systems include the fire alarm detection and fire sprinkler components that protect the assets contained in the various facilities. The contract will provide for repair and necessary documentation to log all accessible components and devices, detector cleaning for fire alarm and detection systems, emergency service call and labor for the fire alarm 24 hours, 7 days a week, and panel and peripheral component replacement for the various electronic systems. Under the contract, the accessible peripheral devices will be functionally tested in accordance with the National Fire Protection Association’s 72 (NFPA) and manufacturer’s recommended procedures.

 

The original contract was established in accordance with the pertinent provisions for Sole Source Procurement of Chapter 329 of the Columbus City Code and authorized under Ordinance No. 1342-2023. Services under the original contract cover a one (1) year period, from date of execution up to and including June 28th, 2024, with the option to renew for four additional years, for a max contract length of five years, based upon mutual agreement, availability of budgeted funds and approval of Columbus City Council.

 

Ordinance 0670-2024 authorized the first renewal option, increasing funding allocations by $90,000.00 and extending the contract through August 16th, 2025.

Ordinance 1432-2025 authorized the second renewal option, increasing funding allocations by $174,750.00 and extending the contract through July 28th, 2026.

This ordinance authorizes the third one-year renewal option of the contract, extending the contract expiration date through August 16th, 2027, and is being submitted in accordance with the relevant provisions of Chapter 329 of City Code. For each year of the contract, funding is contingent on availability within the budget, mutual agreement between the parties, approval of City Council, and certification of funds by the City Auditor. This contract does not automatically renew. If unforeseen issues or difficulties are encountered that would require additional funding, a modification would be requested.

1. Amount of additional funds: Total amount of additional funds needed for this contract renewal #3 is to add $143,108.03. Total contract amount including this renewal is $496,977.36.

 

2. Reason additional funds were not foreseen: The need for additional funds was known at the time of the initial contract. This renewal is to provide the additional funding necessary for the payment of services provided through August 16th, 2027.

 

3. Reason other procurement processes were not used: The vendor is the sole provider of this service.

 

4. How cost was determined: The cost, terms and conditions are in accordance with the original agreement and the quote provided.

Body

 

WHEREAS, it is necessary to authorize the Director of the Department of Public Utilities to renew and increase an existing sole source agreement with Johnson Controls Fire Protection LP for life safety system maintenance services; and

 

WHEREAS, Ordinance 1342-2023 authorized the initial term of the contract; and

 

WHEREAS, Ordinance 0670-2024 authorized the first contract renewal to extend the contract expiration date up to and including August 16th, 2025, and add additional funding; and

 

WHEREAS, Ordinance 1432-2025 authorized the second contract renewal to extend the contract expiration date up to and including July 28th, 2026, and add additional funding; and

 

WHEREAS, The Department of Public Utilities wishes to renew the sole source contract for an additional year, up to and including August 16th, 2027, and provide additional funding for the same services as under the original agreement; and

 

WHEREAS, this ordinance is being submitted in accordance with the relevant provisions of Chapter 329 of City Code pertaining to contract renewals; and

 

WHEREAS, it is necessary to authorize the expenditure of $143,108.03 from within the Sanitary Sewer Operating Fund; and

 

WHEREAS, it has become necessary in the usual daily operations of the Department of Public Utilities in that it is necessary to authorize the Director to enter into a renewal agreement with Johnson Controls Fire Protection LP for life safety system maintenance services; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Director of Public Utilities is authorized to renew an existing sole source agreement with Johnson Controls Fire Protection LP for life safety system maintenance services. The amount being authorized by this ordinance is $143,108.03. 

 

SECTION 2.  That this renewal No. 3 is in accordance with the relevant provisions of City Code, Chapter 329, relating to contract modifications and renewals.

SECTION 3. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 4. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 5.  That for the purpose stated in Section 1, the expenditure of $143,108.03, or so much thereof as may be needed, be and is hereby authorized in object class 02 Materials & Supplies and 03 Services, from within the Sanitary Sewer Operating Fund, per the accounting codes in the attachment to this ordinance.

 

SECTION 6. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
