Explanation

 

BACKGROUND:

This ordinance approves the acceptance of certain territory (AN26-006) by the city of Columbus. The Ohio Revised Code stipulates that to be effective, City acceptance must take place a minimum of 60 days from the receipt by the City Clerk of the approval notice from the county. If City Council does not accept the ordinance within 120 days of its first consideration, the annexation will be considered rejected. This petition was filed with Franklin County on May 4, 2026. Franklin County approved the annexation on June 2, 2026 and the City Clerk received notice on June 11, 2026.

FISCAL IMPACT:

Provision of municipal services does represent cost to the City; however, the annexation of land also has the potential to create revenue to the City.

To accept the application (AN26-006) of April L. Gates for the annexation of certain territory containing 1.89± acres in Plain Township. ($0.00)

 

Body

 

WHEREAS, a petition for the annexation of certain territory in Plain Township was filed on behalf of April L. Gates on May 4, 2026; and

WHEREAS, the petition was considered and approved by the Franklin County Board of Commissioners at a hearing on June 2, 2026; and

WHEREAS, on June 11, 2026, the City Clerk received from Franklin County a certified copy of the resolution addressing the petition; and

WHEREAS, sixty days have now elapsed since receipt of the resolution in accordance with the provisions of the Ohio Revised Code; and

WHEREAS, it is in the best interest of the city of Columbus to accept the annexation of the territory addressed by the petition; now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS

SECTION 1. That the annexation proposed by April L. Gates in a petition filed with the Franklin County Board of Commissioners on May 4, 2026 and subsequently approved by the Board on June 2, 2026 is hereby accepted and said territory is hereby annexed to the city of Columbus. Said territory is described as follows:

Situated in the State of Ohio, County of Franklin, Township of Plain, being located in Quarter Township 3, Township 2, Range 16, United States Military Lands, being all of the remainder of that 2 acre (original) tract described in a deed to April L. Gates (Auditor's Tax Parcel 220-000869), of record in Official Record 17887, Page D09, and being part of that 0.169 acre right-of-way parcel described as Parcel 64-WD in a deed to City of Columbus, Ohio, of record in Instrument Number 201811270159650, all records referenced herein are on file at the Office of the Recorder for Franklin County, Ohio, and being further bounded and described as follows:

Commencing for reference at the northwest corner of said 2 acre (original) tract, being the northwest corner of said Parcel 64-WD, being the southwest corner of that 0.138 acre right-of-way parcel described in a deed to City of Columbus, Ohio, of record in Instrument Number 200408230196800, and being on the existing centerline of right-of-way for Hamilton Road (Public - variable width);

Thence South 86 degrees 52 minutes 45 seconds East, along the north line of said 2 acre (original) tract, along the north line of said Parcel 64-WD, along the south line of said 0.138 acre right-of-way parcel, and across said Hamilton Road (Public -variable width), a distance of 40.00 feet to a point on the Existing City of Columbus Corporation Line, as established by Ordinance Number 0496-04, of record in Instrument Number 200407190166449, said point being the TRUE POINT OF BEGINNING for this description;

Thence South 86 degrees 52 minutes 45 seconds East, along said Existing City of Columbus Corporation Line, continuing along the north line of said 2 acre (original) tract, continuing along the north line of said Parcel 64-WD, continuing along the south line of said 0.138 acre right-of-way parcel, along the south line of that 1.495 acre tract described in a deed to TJB Investments, LLC, of record in Instrument Number 200409010205552, and continuing across said Hamilton Road (Public - variable width), a distance of 671.47 feet (passing the existing east right-of-way line for Hamilton Road, being the northeast corner of said Parcel 64-WD, being the northwest corner of the remainder of said 2 acre (original) tract, being the southeast corner of said 0.138 acre right-of-way parcel, and being the southwest corner of said 1.495 acre tract at a distance of 20.00 feet) to the northeast corner of said 2 acre (original) tract, being the southeast corner of said 1.495 acre tract, being on the west line of The Preserve Section 6 Part 1, as numbered and delineated in Plat Book 97, Page 71, being on said Existing City of Columbus Corporation Line, as established by Ordinance Number 1158-78, of record in Miscellaneous Book 170, Page 268;

Thence North 86 degrees 52 minutes 45 seconds West, continuing along said Existing City of Columbus Corporation Line, along the proposed City of Columbus corporation line, along the south line of said 2 acre (original) tract, along the north line of said 3 acre tract, along the north line of that 1.762 acre tract described in a deed to Hamilton Crest LLC, of record in Instrument Number 202406180060460, along the south line of said Parcel 64-WD, along the north line of that 0.194 acre right-of-way parcel described as Parcel 62-WD in a deed to City of Columbus, Ohio, of record in Instrument Number 201812270174046, and across Hamilton Road, a distance of 671.25 feet (passing the northwest corner of said 3 acre tract, being the northeast corner of said 1.762 acre tract, and being a northwest corner of said Existing City of Columbus Corporation Line, at a distance of 107.25 feet; passing the existing east right-of-way line for Hamilton Road (Public - variable width), being the southwest corner of the remainder of said 2 acre (original) tract, being the northwest corner of said 1.762 acre tract, being the southeast corner of said Parcel 64-WD and being the northeast corner of said Parcel 62-WD, at a distance of 651.25 feet) to a point on said Existing City of Columbus Corporation Line, as established by Ordinance Number 0496-04, of record in Instrument Number 200407190166449;

Thence North 03 degrees 19 minutes 20 seconds East, along said Existing City of Columbus Corporation Line, across said 2 acre (original) tract, across said Parcel 64-WD, and across said Hamilton Road (Public - variable width), a distance of 122.48 feet to the TRUE POINT OF BEGINNING for this description.

The above description contains a total area of 1.888 acres, of which:

1.831 acres is located within Franklin County Auditor's parcel number 220-000869,

0.057 acres is located within the dedicated right-of-way for Hamilton Road.

Bearings described hereon are based on North 03°19'20" East for the existing centerline of right-of-way for North Hamilton Road, measured from Grid North, referenced to the Ohio State Plane Coordinate System (South Zone) and the North American Datum of 1983 (2011 Adjustment), as established utilizing a GPS survey and an NGS OPUS solution.

This description is intended for annexation purposes only.

The total perimeter of annexation is 1,587.68 feet, of which 1,023.68 feet is contiguous Existing City of Columbus Corporation Line (64.48% of total perimeter).

This description was prepared under the direct supervision of Jonathan B. Youmans, Registered Professional Surveyor No. 8846 on March 9, 2026, is based on an actual field survey performed by American Structurepoint. Inc., and is true and correct to the best of my knowledge and belief.

SECTION 2. That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.

SECTION 3. That pursuant to the provisions of Section 503.07 of the Ohio Revised Code the Director of the Department of Development be and is hereby authorized and directed on behalf of the City of Columbus to present to the Board of Commissioners of Franklin County, Ohio, a petition requesting such changes in and extensions of the boundary lines of Montgomery Township as may be necessary so that said township may include therein that portion of Plain Township, which by the order of the Board of County Commissioners of Franklin County, Ohio, on June 2, 2026 was approved for annexation to the city of Columbus, so as to make the boundaries of Montgomery Township co-extensive with the corporate limits of the said city of Columbus in accordance with the maps attached to said petition.

SECTION 4. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
