Explanation
Background: The following is an ordinance to authorize the City Attorney to acquire fee simple title and lesser interests, contract for professional services, and to expend the monies for payment of acquisition costs in connection with the Charleston Avenue Stormwater System Improvements Project.
Fiscal Impact: The Department of Public Utilities, Division of Sewers and Drains is requesting an amendment to the 2005 Capital Improvements Budget for purposes of establishing sufficient budget authority for this expenditure. In addition, this legislation includes a transfer of funds within the Storm Sewer Bonds Fund.
Emergency Justification: Emergency action is requested to allow acquisition activities to continue uninterrupted in order to maintain The Department of Public Utilities acquisition schedule.

To authorize the City Attorney to acquire fee simple title and lesser interests; contract for professional services; to authorize the transfer of $85,000.00 within the Storm Sewer Bond Fund; to authorize an amendment to the 2005 Capital Improvements budget; for the Division of Sewerage and Drainage; to expend $85,000.00 from the Storm Sewer Bonds Fund; necessary to the Charleston Avenue Stormwater System Improvements Project; and to declare an emergency. WHEREAS, the City of Columbus is engaged in the Charleston Avenue Stormwater System Improvements Project; and
WHEREAS, it is necessary to transfer money within the Storm Sewer Bond Fund for the Charleston Avenue Stormwater System Improvements Project; and
WHEREAS, it is necessary to authorize an amendment to the 2005 Capital Improvements Budget for purposes of providing sufficient funding and spending authority for the aforementioned project expenditure; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, in that it is immediately necessary to authorize the City Attorney to acquire fee simple title and lesser interests in and to certain parcels of real estate and to contract for the aforesaid professional services necessary in connection with said project for the preservation of the public health, peace, property and safety; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the City Attorney be, and hereby is, authorized to acquire fee simple title and lesser interests in and to certain parcels of real estate and to contract for the professional services necessary in connection with the Charleston Avenue Stormwater System Improvements Project, Project Number 610742.
Section 2. That the City Auditor is hereby authorized to transfer $85,000.00 within the Storm Sewer Bonds Fund, Fund 685, Division of Sewerage and Drainage, Division 60-15, Object Level One 06, Object Level Three 6601, as follows:

Section 3. That the expenditure of $85,000.00, or so much thereof as may be necessary from the Storm Sewer Bonds Fund, Fund #685; Dept./Div. 60-15, Project No.610742, OCA Code 685742, Object Level Three 6601, for the aforesaid purpose is hereby authorized.
Section 4. That the 2005 Capital Improvements Budget Ordinance No. 1070-2005 is hereby amended as follows, to provide sufficient budget authority for the acquisition costs in connection with the Charleston Avenue Stormwater System Improvements Project stated in Section 1 herein.

Section 5. That for the reasons stated in the preamble hereto, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
