Explanation
 
1.  BACKGROUND:  This legislation authorizes the Director of Public Utilities to enter into an agreement with Evans, Mechwart, Hambleton & Tilton, Inc. (EMH&T), for professional engineering services for the Bliss Run Relief Trunk Sewer Phase 3 Project.  This project will address long-standing flooding problems in this East Columbus neighborhood.  The construction contract with Kokosing Construction Company is currently being finalized.  City Council passed legislation authorizing the Public Utilities Director to enter into this construction contract in the amount of $11,487,560.43 on February 6, 2006.
 
2.  ENGINEERING CONTRACT AWARD:  EMH&T was selected in accordance with the procedures set forth in Columbus City Code, Section 329.14, "Awarding professional service contracts through requests for proposals".  A request for proposals (RFP) was placed on the City's webpage on October 25, 2005.  Four proposals were received and opened on November 11, 2005.  
 
Upon review of the technical proposals, the bidders were ranked using criteria specified in City Code, and more specifically: competence to perform the required services, past performance, rates/estimated hours, quality/feasibility of the technical proposal, and location of the workforce.
 
Based upon these criteria, EMH&T, Inc. was selected as the highest-ranked bidder.  Their Contract Compliance Number is 31-0685594.
 
3.  EMERGENCY DESIGNATION:  It is requested that this Ordinance be processed in an emergency manner as the construction administration contract needs to be in place in order to proceed with construction work.  Construction needs to proceed as soon as possible to ensure sufficient progress during the 2006 construction season.
 
4.  FISCAL IMPACT:  The Division is requesting an amendment to the 2005 Capital Improvements Budget for purposes of establishing sufficient budget authority for this expenditure.  In addition, this legislation includes a transfer of funds within the Storm Sewer Bonds Fund.

WHEREAS, it is necessary to transfer money within the Storm Sewer Bond Fund for the Bliss Run Relief Trunk Sewer Phase 3 Project; and
 
WHEREAS, it is necessary to authorize an amendment to the 2005 Capital Improvements Budget for purposes of providing sufficient funding and spending authority for the aforementioned project expenditure; and
 
WHEREAS, it is necessary to authorize the Director of Public Utilities to enter into an agreement for professional engineering services as this project will address long-standing flooding problems in this East Columbus neighborhood; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, in that it is immediately necessary to authorize the Director of Public Utilities to modify the contract for professional engineering design and technical project services, for the Bliss Run Relief Trunk Sewer Phase 3 Project, in an emergency manner as the construction administration contract needs to be in place in order to proceed with construction work, for the immediate preservation of the public health, peace, property and safety; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the City Auditor is hereby authorized to transfer $513,514.00 within the Storm Sewer Bonds Fund, Fund 685, Division of Sewerage and Drainage, Division 60-15, Object Level One 06, Object Level Three 6682, as follows:
 
TRANSFER FROM:      610846 - West Fifth Avenue Underpass
                  OCA Code - 685846
 
TRANSFER TO:      610923 - Bliss Run Relief Trunk, Phase 3
                              OCA Code - 685923
 
Section 2.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
 
Section 3.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
Section 4.  That the Director of Public Utilities be and hereby is authorized to execute an agreement with Evans, Mechwart, Hambleton & Tilton, Inc. (EMH&T), 5500 New Albany Rd., Columbus, Ohio 43054, for the Division of Sewerage and Drainage, for professional engineering services in accordance with the terms and conditions on file in the office of the Division of Sewerage and Drainage.
 
Section 5. That the said engineering firm shall conduct the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Sewerage and Drainage.
 
Section 6. That for the purpose of paying the cost of the professional engineering services contract, the following expenditure, or as much thereof as may be needed, be and the same is hereby authorized as follows:  Division 60-15, Fund 685, Project 610923, Object Level One 06, Object Level Three 6682, OCA Code 685923, Amount $513,514.00.
 
Section 7.  That the 2005 Capital Improvements Budget Ordinance No. 1070-2005 is hereby amended as follows, to provide sufficient budget authority for the execution of the construction contract stated in Section 6 herein.

Section 8. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
