Explanation
 
Background: This ordinance authorizes the Franklin County Municipal Court Clerk to modify and extend the contract with Capital Recovery Systems, Inc. for an additional eight months,  for the provision of collection services for the Clerk's accounts receivables and authorizes an expenditure up to $40,000.00.
 
Ordinance 1404-2006, approved by Council on July 14, 2006 authorized the Clerk to modify and extend the contract through April 2, 2007 to collect on cases that the company currently had in their possession.  The Clerk is requesting an additional eight months for Capital Recovery Systems, Inc. to continue to collect on these same cases and sufficiently complete the collection process  as well as to return all case data to the Franklin County Municipal Court Clerk.
 
This company is not debarred according to the excluded party listing system of the Federal Government or prohibited from being awarded a contract according to the Auditor of State unresolved finding for recovery certified search.
 
Emergency:  Emergency declaration is requested for the continuity of the collection process.
 
Fiscal Impact:  This contract is self-funding and shall result in additional revenues to the general fund.  No payment of services will be made until monies for the collection of the accounts receivable are deposited with the Clerk and subsequently with the City Treasurer.  The amount of $40,000.00 is available within the Clerk's collection fund appropriations.

Title
 
To authorize and direct the Franklin County Municipal Court Clerk to modify and extend  the accounts receivables contract with Capital Recovery Systems, Inc for the Franklin County Municipal Court Clerk's office; to authorize an additional expenditure up to $40,000.00 from the Clerk's collection fund appropriations; and to declare an emergency. Whereas, it is necessary to enter into a contract with Capital Recovery Systems, Inc. for an additional eight months to continue to collect and sufficiently complete the collection process for the cases that they currently have and to return all case data to the Franklin County Municipal Court Clerk; and
 
Whereas, the current collection contract expires April 2, 2007; and
 
Whereas, it is in the best interest of the City to modify and extend the contract with Capital Recovery Systems, Inc., pursuant 329.16; and  
 
Whereas, an emergency exists in the daily operations of the Franklin County Municipal Court Clerk, in that it is immediately necessary to modify and extend said contract with Capital Recovery Systems, Inc. to continue the collection services without interruption, for the immediate preservation of the public peace, health, safety and welfare, now therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Franklin County Municipal Court Clerk be and hereby authorized to modify and extend the contract for eight additional months, commencing April 3, 2007 through December 2, 2007 with Capital Recovery Systems, Inc. to collect the Clerk's accounts receivables.
 
Section 2.  That an additional expenditure of $40,000.00 or so much thereof as may be needed to be expended from the Clerk's collection fee special revenue fund, department 2601, fund 295, subfund 002, oca 261295, object level one 03, object level three-3336.
 
Section 3.  That pursuant to 329.16 of the Columbus City Code, Council finds it in the best interest of the City to modify the contract with Capital Recovery Systems, Inc.
 
Section 4.  That for reasons stated in the preamble hereto, where is hereby made a part hereof, this ordinance is hereby declared an emergency measure, which shall take effect and be in force from and after its passage and approved by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
