Explanation
1. BACKGROUND:
This legislation authorizes the Director of Public Service to enter into a construction contract in the amount of $291,523.20, with the Double Z Construction Company, in connection with the Roadway Improvement - Noe Bixby Road Rehabilitation and Slope Stabilization Emergency Project.
This ordinance further authorizes the expenditure of $43,728.48 for the payment of construction administration and inspection services.
A Mayor's Emergency was declared on April 27, 2011, in response to Department of Public Service engineering personnel determining it immediately necessary to perform an emergency rehabilitation of a section of Noe Bixby Road
This Project is an emergency to rehabilitate a portion of Noe Bixby Road South of Livingston Avenue due to the failure of the side slope to the Big Walnut Creek. This slope failure has encroached onto the adjacent roadway causing hazard to the traveling public.
No existing sidewalks are present, this Project is an emergency, corrective rehabilitation and will occur on the Big Walnut Creek side of the roadway only and will not construct sidewalks. No ADA ramps will be added or reconstructed on this project.
The estimated Notice to Proceed date is May 2, 2011. The contract length is 30 calendar days from the Notice to Proceed date. Due to the emergency nature and short turnaround time necessary for this project 3 vendors were solicited to submit bids. Bids were received on April 22, 2011 (3 majority) and tabulated on April 23, 2011 as follows:

Award is to be made to Double Z Construction Company as the lowest, best, most responsive and most responsible bidder.
Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Double Z Construction Company.
2. FISCAL IMPACT:
This is an emergency rehabilitation project and was not authorized within the 2011 Capital Improvement Budget. This ordinance authorizes an amendment to the 2011 C.I.B. to reallocate authority for this project.
Funding in the amount of $335,251.68 within the Streets and Highway Improvement Fund. This is the remaining local share from the Henderson Road Grant and was made available due to the closeout of that grant
The Mayor's Emergency Declaration authorized the temporary use of Street Construction, Maintenance and Repair Funds (SCMRF) to facilitate the execution of this contract work. This ordinance will replace the SCMR funding with more appropriate capital improvement funding.
3. EMERGENCY LEGISLATION:
The Division is requesting that this legislation be considered an emergency measure in order to replace the temporary operating budget funding of these contractual services with capital improvement funds to allow for the payment of services that were authorized within the Mayor's Emergency Declaration of April 27, 2011.

WHEREAS, A Mayor's Emergency was declared on April 27, 2011, for purposes of undertaking the necessary action to rehabilitate a section of Noe Bixby Road south of Livingston Avenue; and
WHEREAS, Department of Public Service engineering personnel have determined that it is necessary to conduct this rehabilitation project to construct needed improvements to this roadway; and
WHEREAS, bids were received on April 22, 2011, and tabulated on April 23, 2011, for the Roadway Improvement - Noe Bixby Road Rehabilitation and Slope Stabilization Emergency Project and a satisfactory bid has been received; and
WHEREAS, it is necessary to provide for construction inspection costs; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Design and Construction, in that City Engineers have determined that this roadway is in need of rehabilitation to provide for the safety of the travelling public and it is urgently required to contract for the necessary emergency roadway and construction administration inspection services as described above, in order to allow for the immediate payment of said services as required to ensure for the completion of this roadway infrastructure rehabilitation project, thereby preserving the public health, peace and safety; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Public Service, be and hereby is, authorized to enter into contract with the Double Z Construction Company, 2550 Harrison Road, Columbus Ohio 43204; and to pay up to a maximum amount of $291,523.20, in connection with the Roadway Improvement - Noe Bixby Road Rehabilitation and Slope Stabilization Emergency Project, in accordance with the terms and conditions as shown in the contract on file in the Office of Support Services with the Department of Public Service and to provide for construction inspection services in the amount of $43,728.48.
SECTION 2. That the 2011 Capital Improvements Budget established within ordinance 0266-2011 be and hereby is amended to provide funding for this project as follows:

SECTION 3. The sum of $335,251.68 be and is hereby appropriated from the unappropriated balance of the Streets and Highways Improvement Fund, Fund 766, and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ending December 31, 2011 for the Division of Design and Construction, Dept-Div 59-12, Project Number 590014-100000, O.L. 01-03 Codes 06-6600, OCA Code 766014.
SECTION 4. That the transfer of cash and appropriation within the Street and Highway Improvement Fund, No. 766, be authorized as follows

SECTION 6. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
