NWD INVESTMENTS, LLC, an Ohio limited liability company, by Manager and Member, NATIONWIDE REALTY INVESTORS, LTD., an Ohio limited liability company, by BRIAN J. ELLIS, President and Chief Operating Officer and THE FRANKLIN COUNTY CONVENTION FACILITIES AUTHORITY, by WILLIAM C. JENNISON, Executive Director, and JOHN S. CHRISTIE, CHAIRMAN, have submitted the plats titled COLUMBUS CONVENTION CENTER DRIVE AND SCHOOL ALLEY DEDICATION AND EASEMENTS and COLUMBUS CONVENTION CENTER DRIVE DEDICATION PART 2 to the City Engineer's Office for review and approval.  These plats have been reviewed and approved by the City Engineer.  Furthermore, with the development of the Arena Site, Vine Street was extended from Neil Avenue to Kilbourne Street through lands owned by the City of Columbus.  The following legislation allows the City to accept said plats for property located south of Vine Street between Kilbourne Street and Third Street and to dedicate new right-of-way for the extension of Vine Street from Neil Avenue to Kilbourne Street.

ELLIS, President and Chief Operating Officer and COLUMBUS CONVENTION CENTER DRIVE DEDICATION PART 2, from THE FRANKLIN COUNTY CONVENTION FACILITIES AUTHORITY, by WILLIAM C. JENNISON, Executive Director, and JOHN S. CHRISTIE, CHAIRMAN, and to dedicate new right-of-way for the extension of Vine Street from Neil Avenue to Kilbourne Street.

WHEREAS, the plats titled COLUMBUS CONVENTION CENTER DRIVE AND SCHOOL ALLEY DEDICATION AND EASEMENTS and COLUMBUS CONVENTION CENTER DRIVE DEDICATION PART 2 (hereinafter "plats"), have been submitted to the City Engineer's Office for approval and acceptance; and
 
WHEREAS, NWD INVESTMENTS, LLC, an Ohio limited liability company, by Manager and Member, NATIONWIDE REALTY INVESTORS, LTD., an Ohio limited liability company, by BRIAN J. ELLIS, President and Chief Operating Officer and THE FRANKLIN COUNTY CONVENTION FACILITIES AUTHORITY, by WILLIAM C. JENNISON, Executive Director, and JOHN S. CHRISTIE, CHAIRMAN, owners of the platted land, desires to dedicate to the public use all or such parts of the Drive shown on said plats and not heretofore so dedicated; and
 
WHEREAS, after examination, it has been found to be in the best interest of the City to accept said plats; and
 
WHEREAS, Ohio Revised Code Chapter 723.03 requires that property to be used as a public street or alley must be accepted and dedicated as public right-of-way by an ordinance specially passed for such purpose; now, therefore
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.      That the plat titled COLUMBUS CONVENTION CENTER DRIVE AND SCHOOL ALLEY DEDICATION AND EASEMENTS on file in the office of the City Engineer, Transportation Division, be and the same is hereby accepted.
 
Section 2.      That the plat titled COLUMBUS CONVENTION CENTER DRIVE DEDICATION PART 2 on file in the office of the City Engineer, Transportation Division, be and the same is hereby accepted.
 
Section 3.  That the City of Columbus hereby dedicates the following described property as right-of-way for roadway purposes and shall be named and dedicated as Neil Avenue, Vine Street and Kilbourne Street;
 
      Situated in the State of Ohio, County of Franklin, City of Columbus, lying in Half Section 10, Section 8, Township 5, Range 22, Refugee Lands, being all of that 1.438 acre tract, a part of that 2.172 acre tract, and a part of that 0.604 acre tract conveyed to City of Columbus of record in Instrument Numbers 199912300318817 and 199912300318818, and described as follows:
      Beginning at a P.K. nail found at the intersection of the easterly right-of-way line of Neil Avenue with the northerly right-of-way line of Railroad Street, also being a northwesterly corner of said 0.604 acre tract, a northwesterly corner of the remainder of that 4.912 acre tract conveyed to NWD Investments, LLC of record in Instrument Number 199902180041487, and a southwesterly corner of said 1.438 acre tract;
      thence North 00° 53' 05" East, with said easterly right-of-way line, the westerly line of said 1.438 acre tract, a distance of 424.84 feet to an iron pin set at a northwesterly corner of said 1.438 acre tract and a southwesterly corner of that tract conveyed to HP Land Development, Ltd. of record in Instrument Number 200012290262084;
      thence with the common perimeter of said 1.438 acre tract and said HP Land Development tract, the following courses:
      South 01° 47' 54" East, a distance of 151.24 feet to an iron pin set;
South 41° 34' 32" East, a distance of 55.47 feet to an iron pin set at a point on a curve to the left;
eastwardly, with the arc of said curve, having a central angle of 06° 40' 38", a radius of 869.50 feet, an arc length of 101.33 feet, and a chord bearing and chord distance of North 89° 34' 08" East, 101.27 feet to an iron pin set at a point on a curve to the left;
northeastwardly, with the arc of said curve, having a central angle of 10° 47' 30", a radius of 764.00 feet, an arc length of 143.90 feet, and a chord bearing and chord distance of North 77° 59' 47" East, 143.69 feet to an iron pin set at a point of reverse curvature to the right;
northeastwardly, with the arc of said curve, having a central angle of 10° 19' 34", a radius of 836.00, an arc length of 150.67 feet, and a chord bearing and chord distance of North 77° 45' 51" East, 150.46 feet to an iron pin set;

      thence North 00° 58' 59" East, across said 0.604 acre tract, with the line common to said 1.438 and 2.172 acre tracts, a distance of 253.77 feet to an iron pin set at a common corner of said 1.438 and 2.172 acre tracts;

southwestwardly, with the arc of said curve, having a central angle of 12° 45' 34", a radius of 751.00 feet, an arc length of 167.24, and a chord bearing and chord distance of South 78° 58' 52" West, 166.90 feet to an iron pin set at a point of reverse curvature to the right;
southwestwardly, with the arc of said curve having a central angle of 17° 57' 53", a radius of 849.00 feet, an arc length of 266.20 feet, and a chord bearing and chord distance of South 81° 35' 01" West, 265.11 feet to an iron pin set;
      South 45° 04' 28" West, a distance of 40.66 feet, to an iron pin set at a common corner to said 1.438 and 2.172 acre tracts;
      thence South 00° 58' 10" West, with a line common to said 1.438 and 2.172 acre tracts, and across said 0.604 acre tract, a distance of 124.81 feet to an iron pin set in a line common to said 0.604 and 4.912 acre tract;
      thence North 64° 21' 30" West, with a line common to said 0.604 and 4.912 acre tracts, distance of 24.61 feet to the Point of Beginning, containing 1.768 acres, more or less.
      Subject, however, to all legal rights-of-way and/or easements, if any, of previous record.
      Iron pins set, where indicated, are iron pipes, thirteen sixteenths (13/16) inch inside diameter, thirty (30) inches long with a plastic plug placed in the top bearing the initials EMHT INC.
      Bearings are based on the North line of Maple Street, being South 89° 08' 05" East, as per Governor's Deed to the City of Columbus, Ohio of record in Official Record 30337I04.
