BACKGROUND:
This legislation authorizes the Director of Development to enter into a Metro Park Development Agreement providing for development of a natural area Metro Park in the unincorporated area of Plain Township west of Peter Hoover Road and north of Walnut Street. The Metro Park Development Agreement is among the City of Columbus, the Village of New Albany, Plain Township, and Metro Parks.  It is closely related to an Annexation Agreement for a future Metro Park that the Columbus City Council approved on December 11, 2006, by Ordinance 2262-2006.

Body
 
WHEREAS, this legislation authorizes the Director of Development to enter into a Metro Park Development Agreement providing
for development of a natural area Metro Park in the unincorporated area of Plain Township west of Peter Hoover Road and north of
Walnut Street; and  
 
WHEREAS, the Metro Park Development Agreement is among the City of Columbus, the Village of New Albany, Plain Township, and Metro Parks; and
WHEREAS, one of the purposes of the Agreement is to provide for the general location of the Metro Park, and the parameters for the land acquisition, development, and management of said Metro Park; and
 
WHEREAS, an additional purpose of the Reimbursement Agreement is to delineate the amount, manner and timing of initial payments to be made by the City of Columbus, The Village of New Albany, and Metro Parks to effectuate this Agreement; and Now, Therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
Section 1.   The Metro Park Development Agreement by and among this City, the Village of New Albany Company, Plain Township, and Metro Parks, in the form presently on file with the Columbus City Clerk, providing for, among other things, the creation of a Metro Park with a goal of ultimately being approximately 1200 acres, and with a payment by the City of Columbus to Metro Parks of $7.5 million entirely from TIF revenues, is hereby approved and authorized with changes therein and amendments thereto not inconsistent with this Ordinance and not substantially adverse to this City and which shall be approved by the Director of Development.  The Director of Development, for and in the name of this City, is hereby authorized to execute that Metro Park Development Agreement, provided further that the approval of changes and amendments thereto by that official, and their character as not being substantially adverse to the City, shall be evidenced conclusively by the Director of Development's execution thereof.  This Council further hereby authorizes and directs the Mayor, the Director of Development and the City Attorney, and other appropriate officers of the City, to sign those instruments and make those arrangements as are necessary carry out the purposes of this Ordinance.                                     
 
Section 2.  That any expenditure of the City pursuant to this Agreement is subject to future ordinances of City Council authorizing such expenditure and certification by the City Auditor of the availability of such funds.
Section 3. That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
