Explanation
1.  BACKGROUND:  This legislation authorizes the Director of Public Utilities to execute a contract with the Reynolds Inliner, LLC, in the amount of $912,410.80 for the construction of one sanitary sewer improvement project.
 
This legislation authorizes the Director of Public Utilities to execute a contract with Reynolds Inliner, LLC, for the construction of the Broad Meadows Area Sanitary Improvements Project.  This project will repair and rehabilitate approximately 9,525 lineal feet of  8-inch diameter, 460 LF of 10-inch diameter, 701 LF of 12-inch diameter and 360 LF of 15-inch diameter sanitary sewer pipe using the Cured-in-Place Pipe (CIPP) process; the installation of approximately 340 LF of 15-inch diameter sanitary sewer pipe; the dye testing of approximately 9 service connections; the reinstatement of approximately 276 service connections; the rehabilitation of approximately 481 VF of brick and pre-cast concrete manholes utilizing a cementitious lining system; the installation of 1 sanitary sewer manhole; the rehabilitation of 47 manhole bench and channels; the replacement of 48 manhole frames and covers; the open cut replacement of 53 LF of 8-inch sanitary sewer pipe in seven (7) locations; the by-pass pumping, maintaining traffic, and other such work as may be necessary to complete the contract in accordance with the plans (CC-14509) and specifications.  This project will utilize trenchless technology methods to minimize the disruption to residences in the project area and to avoid the costlier method of traditional open trench sewer removal and replacement.   
 
The Director of Public Utilities publicly opened five competitive bid proposals on February 28, 2007.  The result of this bid was that Kokosing Construction Company submitted a bid of $985,245.17; Insituform (MO) submitted a bid of $895,097.24; Visu-Sewer Clean and Seal submitted a bid of $1,002,121.69; Performance Site Company, LLC, submitted a bid of $1,608,559.57 and Reynolds Inliner, LLC, submitted a bid of $912,410.80.  Applying the City's "Quality and Resource Factors" resulted in credits which caused Reynolds Inliner, LLC, to become the apparent low bidder.
 
2.  FISCAL IMPACT:  This ordinance authorizes the transfer and appropriation of funds from the Sewerage System Reserve Fund to the OWDA Loan Fund in order to fund this proposed expenditure.  This transaction is a temporary measure that is required until such time as the Department is able to execute a loan agreement with the Ohio Water Development Authority and reimburse the Sewer System Reserve Fund.
 
3.  EMERGENCY DESIGNATION:  The Division of Sewerage and Drainage is requesting City Council to designate this legislation an emergency measure, in order to allow for the immediate execution of the subject contract.  The sanitary sewer relief projects are one of several projects the City is undertaking to fulfill commitments contained within the Consent Order executed between the City of Columbus and the Ohio Attorney Generals Office.  In order to ensure that the City meets the scheduling constraints of this project, it is imperative that a notice-to-proceed be issued as soon as possible.

Body
WHEREAS, five competitive bids for the construction of Broad Meadows Area Sanitary Improvements were received on February 28, 2007, and
 
WHEREAS, it is immediately necessary for the City Council to both appropriate funds from the Sewer System Reserve Fund and authorize the transfer of said funds into the Ohio Water Development Authority Loan Fund; in order to temporarily fund this expenditure, until such time as the City is able to execute a loan for the above stated purpose and reimburse the Sewer System Reserve Fund; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Sewerage and Drainage in that it is immediately necessary to authorize the Director of Public Utilities to execute a contract for the construction of the aforementioned project; to appropriate and authorize the expenditure of the proceeds from the aforementioned loan; to insure the continuing operation of this vital sanitary sewer infrastructure; thereby preserving the public health, peace and safety; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That from the unappropriated monies in the Sewer System Reserve Fund 654, and from all monies estimated to come into said fund from any and all sources, and unappropriated from any other purpose for the Broad Meadows Area Sanitary Sewer Improvements Project, the sum of $912,410.80 is hereby appropriated to the Division of Sewerage and Drainage, Division 60-05 | Object Level One 10 | Object Level Three 5502 | OCA Code 901654.
 
Section 2.  That the City Auditor is hereby authorized to transfer $912,410.80 to the OWDA Loan Fund No. 666, into the appropriate project accounts as specified within Section 3 herein, at such time as deemed necessary by him, and to expend said funds, or so much thereof as may be necessary.
 
Section 3.  That the expenditure of $912,410.80 is hereby appropriated for the Broad Meadows Area Sanitary Sewer Improvement project within the OWDA Loan Fund No. 666 | Division 60-05 | as follows:

Section 4.  That upon obtaining other funds for the purpose of funding sanitary sewer system capital improvement work, the City Auditor is hereby authorized to repay the Sewer System Reserve Fund the amount transferred under Section 2., above, and said funds are hereby deemed appropriated for such purposes.
 
Section 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for any contract or contract modifications associated with the expenditure of the funds transferred under Section 2., above.
 
Section 6.  That the Director of Public Utilities be, and hereby is, authorized to award and execute a contract for the construction of the Broad Meadows Area Sanitary Sewer Improvements Project with the lowest, and best bidder, Reynolds Inliner, LLC., 4520 N. State Road 37, Orleans, IN 47452, in the amount of $912,410.80, in accordance with the terms and conditions of the Contract on file in the office of the Division of Sewerage and Drainage.
 
Section 7.  That the expenditure of $912,410.80, or as much thereof as may be needed, is hereby authorized from the Ohio Water Development Authority Loan Fund No. 666 | Division 60-05 | as follows:

Section 8.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
