Explanation
Background: Ordinance 1615-1997 passed by City Council June 30, 1997, authorized Columbus Engineering Consultants, Incorporated, to design the Group 10 Intersection Improvements project for the Transportation Division. This project consists of improvements to (1) Neil Avenue/Hudson Street/High Street and (2) Trabue Road/Walcutt Road intersections.
This legislation authorizes a modification of this design contract to provide stand-alone plans for each of these intersections that are now being jointly planned. The plan separation is necessary to provide for the proposed signal at Trabue/Walcutt to be installed in an expeditious manner. In addition, this modification requires that the consultant provide the Transportation Division with computer files of every plan submitted.
This modification is an addition to the original scope of services but is a continuation of the existing work being performed and it would not be practical to contract with a different consultant.
The consultant's current hourly rate, overhead rate and percentage of profit were considered and evaluated from the previous contract modification to determine the amount of this modification. Columbus Engineering Consultants, Incorporated, contract compliance number 31-0716498 (expires April 11, 2008) was selected in June 1997 in accordance with City Code Chapter 329 that governs professional service contracts.
The original contract amount was $283,545.00. This modification is for $10,000.00. The total of all modifications is $185,821.15. The current contract amount including all modifications is $469,366.15.
Fiscal Impact: Funds in the amount of $10,000.00 are available within the Transportation Division's 2004 Capital Improvement Budget in the 1995, 1999 Voted Streets and Highways Fund in the Urban Infrastructure project. This ordinance transfers monies from this project to the Safety Congestion Improvements project as appropriate and authorizes an expenditure of $10,000.00 for a design modification for the Trabue/Walcutt Road intersection improvement.
Emergency action is requested so that the design work can be completed and the proposed signal at the Trabue/Walcutt intersection can be installed in an expeditious manner.

WHEREAS, Contract No. CT-18373 was authorized by Ordinance 1615-1997, passed June 30, 1997, executed and approved by the City Attorney on July 29, 1997; and
WHEREAS, it is necessary to modify this contract to increase the scope of services per the consultant's letter dated April 7, 2005 for the Group 10 Intersections project; and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division in that the contract should be modified and increased immediately to provide for the expeditious installation of the proposed signal at the Trabue/Walcutt intersection to ease congestion, thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the transfer of $10,000.00 between projects within Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department 59-09, Transportation Division, be and hereby is authorized as follows:

SECTION 2. That the Public Service Director be and is hereby authorized to modify and increase Contract CT-18373 with Columbus Engineering Consultants, Incorporated, to complete the design and construction plans and secure the permits for the Group 10 Intersection Improvements project in accordance with the plans on file in the office of the Public Service Director.
SECTION 3. That for the purpose of paying the cost of said contract modification the sum of $10,000.00, or so much thereof as may be necessary, be and hereby is authorized to be expended from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6682, OCA code 644385 and Project 540010.
SECTION 4. That for the reasons stated in the preamble hereto which is hereby made a part hereof this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
