Explanation
 
Background:  This legislation authorizes the Public Service Director to modify the design contract with Dynotec, Inc., in the amount of $15,000.00 for the Group 9 Intersection Improvements - Hamilton Road at Livingston Avenue project. This project adds a right turn lane to all four legs of the intersection.  This contract modification is necessary to separate this intersection from the original plans in order for it to be bid as a separate project in 2005, and to revise curb ramp designs and pavement markings to conform to current ADA specifications. This modification is an addition to the original scope of services but is a continuation of the existing work being performed. Therefore, it would not be practical to contract with a different consultant. Current hourly rates, the overhead rate and the percentage of profit that were negotiated at the beginning of this project were used to determine the amount of this modification. Dynotec, Inc., contract compliance # 31-1319961 (expires July 15, 2005), was selected in 1996 in accordance with Chapter 329 for professional service contracts.
 
The original contract amount was for $190,510.00. The total cost of the contract with this modification is $205,510.00.
 
Emergency action is requested for immediate modification of the design contract for the earliest possible completion of the design to stay on schedule.
 
Fiscal Impact:  The Transportation Division budgeted $550,000 for the Group 9 Intersection Improvements project in the 2004 Capital Improvement Budget.  This ordinance authorizes an expenditure of $15,000.00.  The remaining funds will be used for right-of-way acquisition and utilities relocation.

Body
 
WHEREAS, contract CT-17522 was authorized by Ordinance No. 1462-96, passed June 24, 1996, executed July 19, 1996 and approved by the City Attorney on July 22, 1996; and
 
WHEREAS, it is necessary to modify this contract to increase the scope of services for the Group 9 Intersection Improvements - Hamilton Road at Livingston Avenue project; and
 
WHEREAS, funds for this contract modification are budgeted and available within the roadway improvement project in the 1995, 1999 Voted Streets and Highways Fund with the summer bond sale; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that the contract should be modified and increased immediately so that the work may proceed without delay in order to keep the project on schedule, thereby preserving the public health, peace, property, safety and welfare; now therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1. That the Public Service Director be and hereby is authorized to modify and increase Contract No. CT-17522 with Dynotec, Inc., 1925 E. Dublin Granville Road,  Suite 106, Columbus, Ohio 43229 to revise the construction plans for the Group 9 Intersection Improvements - Hamilton Road at Livingston Avenue project for the Transportation Division in accordance with the documents on file in the office of the Public Service Director.
 
SECTION 2. That for the purpose of paying the cost of the contract modification, the sum of $15,000.00, or so much thereof as may be necessary, be and hereby is authorized to be expended from the Voted 1995, 1999 Streets and Highways Fund, Fund 704, Department No. 59-09, Object Level One Code 06, Object Level Three Code 6682, OCA Code 644385 and Project 530086.
 
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
