Explanation
 
High & Wall Ltd., is renovating an existing commercial building located at 519 South High Street and has recently submitted a request asking that the City grant them an encroachment easement into the west side of South High Street to allow for installation of an ADA accessible ramp and entrance to this building.  Per current Transportation Division practice, comments were solicited from interested parties, including City departments before it was determined that there would be no adverse impact to the City upon the granting of an encroachment easement for this ramp.  A $500.00 value was established for the granting of this easement.
 
The City will receive a total of $500.00, to be deposited in Fund 748, Project 537650, as consideration for the granting of the requested encroachment easement.

WHEREAS, High & Wall, LTD., is renovating an existing commercial building located at 519 South High Street; and
 
WHEREAS, the City of Columbus, Public Service Department, Transportation Division, recently received a request from High & Wall, LTD., asking that the City grant an encroachment easement into the west side of South High Street for installation of an ADA ramp and entrance at 519 South High Street; and
 
WHEREAS, per current Transportation Division practice, comments were solicited from interested parties, including City departments before it was determined there would be no adverse impact to the City upon the granting of the encroachment easement; and
 
WHEREAS, a value of $500.00 has been established for the granting of the requested encroachment easement; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Director of the Public Service Department be and is hereby authorized to execute those documents necessary to grant the following described encroachment easement to High & Wall, LTD.; to-wit:
 
Situated in the City of Columbus, County of Franklin, State of Ohio, and being a 79.50 square foot area located within the right-of-way of High Street to the south of Blenkner Street and to the north of Hoster Street; being more particularly described as follows:
Commencing at the intersection of the westerly right-of-way line of High Street (100' right-of-way) and the southerly right-of-way line of Blenkner Street (33' right-of-way), said point also being the northeasterly corner of Lot No. 685 of McGowan's Addition as recorded in Deed Book "G" Page 70; thence,
Along the westerly right-of-way line of High Street, also being along the easterly line of said Lot No. 685 and then along a portion of the easterly line of Lot No. 684 of said McGowan's Addition, South 00° 00' 00" East, for a distance of ninety-nine and seventy-five one-hundredths feet (99.75') to a point, said point being along the easterly line of a tract of land as conveyed to High & Wall, Ltd. as described in Instrument No. 200005050089084, First Parcel, said point also being the TRUE POINT OF BEGINNING, and from said beginning point running thence,
Along a line perpendicular to the westerly right-of-way line of High Street, South 90° 00' 00" East, for a distance of six and zero one-hundredths feet (6.00') to a point; thence,
Along a line parallel and 6.00' distant to the westerly right-of-way line of High Street, South 00° 00' 00" East, for a distance of thirteen and twenty-five one-hundredths feet (13.25') to a point; thence,
Along a line perpendicular to the westerly right-of-way line of High Street, North 90° 00' 00" West, for a distance of six and zero one-hundredths feet (6.00') to a point, said point being along the westerly right-of-way line of High Street, said point also being along the easterly line of said Lot No. 684, said point also being along the easterly line of said tract of High & Wall, Ltd.; thence,
Along the westerly right-of-way line of High Street, also being along a portion of the easterly line of said Lot No. 684, also being along a portion of the easterly line of said tract of High & Wall, Ltd., North 00° 00' 00" West, for a distance of thirteen and twenty-five one-hundredths feet (13.25') to the point of beginning containing 79.50 square feet (0.002 acres) of land, more or less, as calculated by Kleingers & Associates and Michael L. Keller, Professional Surveyor, Ohio License No. 7978.

Basis of bearings for the above-described courses is based on a portion of the westerly right-of-way line of High Street being an assumed bearing of South 00° 00' 00" East.
