Explanation

 

BACKGROUND:  This legislation authorizes the Director of the Department of Water and Power to enter into a contract for Project Dry Basement with Mid-State Basement Systems LLC. 

The Project Dry Basement: Backwater Valve Installation and/or Sump Pump program consists of installing backwater valves and sump pumps and other such work as maybe necessary to prevent sewer backups in single and two-family homes in Columbus due to surcharging in city sewers from heavy rain or sewer blockages by protecting the home up to the top of casting of the nearest upstream manhole with a Spears or pre-approved backwater valve, which allows use of plumbing fixtures above that elevation in the remainder of the home. Only homes deemed eligible by the City of Columbus, Department of Water and Power, Division of Water Reclamation qualify for this program. Under this program an eligible home with an interior perimeter foundation drain connection to the lateral is also eligible, at the owner’s option, for the installation of a sump pump that will redirect the foundation drainage away from the sanitary lateral to the sump pump and then discharge that drainage away from the house.

The Department of Water and Power advertised formal bids on Vendor Services and solicited formal bids (RFQ 030848). Three bids were received and publicly opened on April 9, 2025.

After a review of the bids, it was determined that Mid-State Basement Systems LLC met the specifications and will be awarded the contract pending the passage of this legislation.

The term of this contract shall be for the period of one year from the date of execution by the City of Columbus, with the option for three (3) additional one year renewals, awarded on a year by year basis, based on funding availability, mutual agreement between the City and the vendor, approval by ordinance of Columbus City Council, and appropriation and certification of funds by the City Auditor. These contracts shall not automatically renew.

The company is not debarred according to the Excluded Party Listing System of the Federal Government or prohibited from being awarded a contract according to the Auditor of State Unresolved Findings for Recovery Certified Search.

Title

 

To authorize the Director of the Department of Public Utilities to enter into a contract with Mid-State Basement Systems LLC, for Project Dry Basement; and to authorize the expenditure of $325,000.00 from the Sewerage Operating Fund. ($325,000.00)

 

Body

WHEREAS, the Division of Water Reclamation advertised and solicited formal bids (RFQ 030848) in accordance with the relevant provisions of Chapter 329 of City Code relating to competitive sealed bids, and

WHEREAS, the Department of Water and Power, Division of Water Reclamation wishes to enter into a contract with Mid-State Basement Systems LLC, for the purpose of providing for the Project Dry Basement:  Backwater Valve Installation and Sump Pump program for the Division of Water Reclamation, and 

WHEREAS, this project is designed to prevent sewer backups in single and two-family homes in Columbus due to surcharging in city sewers from heavy rain or sewer blockages by protecting the home up to the top of casting of the nearest upstream manhole with a Spears or pre-approved backwater valve, which allows use of plumbing fixtures above that elevation in the remainder of the home.  Only homes deemed eligible by the City of Columbus, Department of Water and Power, Division of Water Reclamation qualify for this program, and

WHEREAS, the term of this contract shall be for a period of one year from the date of execution by the City of Columbus, with three (3) additional one year renewal options, determine on a year by year basis, based on funding availability, mutual agreement between the City and vendor, approval by ordinance of Columbus City Council, and appropriation and certification of funds by the City Auditor.  If unforeseen issues or difficulties are encountered that would require additional funding, a modification would be required and is subject to and conditioned upon the approval of City Council, and appropriation and certification of funds by the City Auditor.  These contracts shall not automatically renew, and

WHEREAS, the City may, at any time during the performance of the services under these Agreements propose a modification of the contracts by a properly authorized written instrument.  With the approval of City Council and execution of such modification(s) by each party hereto, it shall be fully incorporated into the appropriate Contract and shall govern all subsequent performance under the Contract, and

WHEREAS, that the expenditure of $325,000.00, or so much there of as may be needed, is hereby authorized in Fund 6100, Sewer Operating Sanitary Fund, as $150,000.00 from object class 02, Materials & Supplies, and $175,000.00 from object class 03 Services, per the accounting codes in the attachment to this ordinance; and

WHEREAS, it has become necessary in the usual daily operations of the Department of Water and Power in that it is necessary to authorize the Director of Water and Power to enter into a contract with Mid-State Basement Systems LLC. for Project Dry Basement; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

SECTION 1.  That the Director of the Department of Water and Power is hereby authorized to enter into a contract with Mid-State Basement Systems LLC The for Project Dry Basement for the Division of Water Reclamation.

 SECTION 2. That this contract is in accordance with the relevant provisions of Chapter 329 of City Code.

SECTION 3. That the expenditure of $325,000.00 or so much thereof as may be needed, is hereby authorized in Fund 6100, Sewer Operating Sanitary Fund, as $150,000.00 from object class 02, Materials and Supplies, and $175,000.00 from object class 03, Services, per the accounting codes in the attachment to this ordinance; and

SECTION 4. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated and the City Auditor shall establish such accounting codes as necessary.

SECTION 5. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

SECTION 6. That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
