Explanation
 
1.      BACKGROUND:
 
A.      Need.  This legislation authorizes the Director of Public Utilities to enter into a professional design services agreement with Chester Engineers, Inc. for the Large Diameter Sewer Assessment - Alum Creek Trunk (Middle)/ Alum Creek Interceptor Sewer Project for the Division of Sewerage and Drainage.  The Division has determined that these services cannot be performed by City personnel at this time, and has planned for the procurement of these services on a routine basis.
 
Work items for this phase of the project shall consist of closed circuit televising and sonar to assess the structural and operational condition of the large diameter trunk sewers identified on the project Exhibit, the providing of an Assessment Report outlining recommendations for their cleaning and/or repair, and all other necessary items for the completion of the Report.
 
Upon receipt and approval of the Assessment Report, the City and the Engineer shall execute a planned modification to this agreement for all professional services necessary for the completion of the design plans/specifications, bidding documents, engineering services during construction, and all other services required for the completion of the project. The first phase of this project shall be for a period of one year. The subsequent planned modification shall also be for one additional year.
 
Original Contract            $ 598,313.22
Future Modifications:        $500,000.00
Total Contract:                    $1,098,313.22
 
B.      Procurement Information: The basis for selection of the chosen professional engineering services firm: The Division advertised Request for Proposals (RFP's) for the subject services in the City Bulletin in accordance with the provisions of Section 329.14 of Columbus City Codes.  The Division of Sewerage and Drainage received technical proposals on July 2, 2010 from the following firms:
 
1.  Brown & Caldwell Ohio, LLC       4.  Stantec Consulting Services, Inc.
      2.  Burgess & Niple, Inc.            5.  Black & Veatch Corp.
      3.  Chester Engineers            6.  MS Consultants, Inc.
 
These proposals were reviewed and ranked by a Professional Engineering Services Selection Committee in order to determine the consultant best qualified to provide the services for this project.  The committee ranked the proposals on quality and feasibility.  After careful consideration, the committee recommended that Chester Engineers, Inc. be selected to provide the engineering services for this study, for which the Division Administrator has concurred.
 
This company is not debarred according to the Federal Excluded Parties Listing or the State Auditor's Findings for Recovery Database.

2.      FISCAL IMPACT:
 
This ordinance authorizes the Director of Public Utilities to expend $598,313.22 in funds from the Sanitary Sewer System GO (General Obligation) Bond Fund, Fund 664 for this expenditure. There is sufficient budget authority in the 2010 Capital Improvements Budget for this expenditure for the Division of Sewerage and Drainage.

Body
 
WHEREAS, the procurement was conducted in accordance with the Request For Proposals (RFP) process set forth in Section 329.14, Columbus City Codes, 1959: Six proposals were received and the Division's Evaluation Committee selected Chester Engineers, Inc. from the six firms; and
 
WHEREAS, the Division of Sewerage and Drainage, Department of Public Utilities, hereby requests this City Council to authorize the Director of Public Utilities to enter into an agreement for professional engineering services with Chester Engineers, Inc. for an amount of $598,313.22 in connection with the Large Diameter Sewer Assessment - Alum Creek Trunk (Middle)/ Alum Creek Interceptor Sewer Project; and
 
WHEREAS, it is necessary for City Council to authorize the expenditure of funds from the Sanitary Sewer System GO Bond Fund, Fund 664; and
 
WHEREAS, the Division of Sewerage and Drainage, Department of Public Utilities is requesting that this Council authorize the Director of Public Utilities to enter into an agreement for professional engineering services with Chester Engineers, Inc. in connection with the Large Diameter Sewer Assessment - Alum Creek Trunk (Middle)/ Alum Creek Interceptor Sewer Project, at the earliest practicable date for the preservation of the public health, peace, property, safety and welfare; Now, Therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.   That the Director of Public Utilities be, and hereby is, authorized to enter into an agreement for professional engineering services with Chester Engineers, Inc. in connection with the Large Diameter Sewer Assessment - Alum Creek Trunk (Middle)/ Alum Creek Interceptor Sewer Project, in accordance with the terms and conditions as shown in the agreement on file in the office of the Division of Sewerage and Drainage.
 
Section 2.  That the City Auditor be and hereby is authorized to expend a total of $598,313.22 or as much as may be needed for the purpose of paying the cost of the professional engineering services agreement from the Sanitary Sewer System GO (General Obligation) Bond Fund, Fund 664 into the Large Diameter Sewer Assessment - Alum Creek Trunk (Middle)/ Alum Creek Interceptor Sewer Project | Fund 664 | Div. 60-05 | Project 650725-100003 | 667253 | Object Level Three 6676.
 
Section 3.  That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be made from a project by monies from more than one source.
 
Section 4. That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
Section 5. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
Section 6.  That the contracted firm shall perform the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Sewerage and Drainage.
 
Section 7.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
