Explanation
1.  BACKGROUND:
This legislation authorizes the Director of Public Service to enter into a professional engineering services contract with Glaus, Pyle, Schomer, Burns & Dehaven, Inc. (GPD Group), for the Bridge and Trail Improvements - West Fifth Avenue from McKinley Avenue to Dublin Road project.   
 
This project involves preliminary and final engineering for a wider Fifth Avenue bridge over the Scioto River and an extension of the Scioto Trail between Dublin Road and McKinley Avenue. In addition to the above improvements, incidental or complete street improvements will be required or considered. These include the following: pavement, curb and gutter, curb ramps, sidewalk, street lighting, street trees, public and private utility work as needed, and stormwater improvements.
 
This is a joint project between the Department of Public Service and the Department of Recreation and Parks that will receive construction funding from ODOT Municipal Bridge Program and MORPC Transportation Enhancements. The ODOT designated name for this project is FRA-Scioto Trail/Fifth Avenue Connector (PID 90382).
Design will proceed in two parts with Part 1 consisting of preliminary engineering, geotechnical investigation, surveying, and preliminary environmental investigations. The specific scope of work for Part 2 will be developed upon completion of Part 1 and will generally consist of final engineering, environmental clearance, and construction plan production.
16 ADA ramps will be added or reconstructed in this project.  There are 6 bus stops and transit routes within the limits of this project.  This project complies with the recommendation of the Pedestrian Thoroughfare Plan because the project will utilize the PTP for guidance in determining improvements.  Pedestrian generators and destinations impacting the proposed project include large multi-family residential apartment complexes (Runaway Bay and the Quarry) and several office buildings.
 
Design costs, including both parts described above, are estimated to be $650K of which $203,915.97 is requested for Part 1. This contract will determine costs for construction, acquisition, utility reimbursement, and inspection.
The Department of Public Service, Office of Support Services solicited Requests for Proposals for the Bridge and Trail Improvements - West Fifth Avenue from McKinley Avenue to Dublin Road contract.  The project was formally advertised on the Vendor Services web site from December 22, 2011, to January 26, 2012.  The city received six (6) responses.  A proposal from Jones-Stuckey, Ltd. was deemed non-responsive due to their not meeting all required ODOT pre-qualification categories.
 
The remaining proposals were deemed responsive and were fully evaluated when the Evaluation Committee met on February 13, 2012.

Glaus, Pyle, Schomer, Burns & Dehaven, Inc. received the highest score by the evaluation committee and will be awarded the Bridge and Trail Improvements - West Fifth Avenue from McKinley Avenue to Dublin Road  contract in an amount up to $203,915.97.
Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Glaus, Pyle, Schomer, Burns & Dehaven, Inc.
 
3. CONTRACT COMPLIANCE
The contract compliance number for Glaus, Pyle, Schomer, Burns & Dehaven, Inc., is 341134715 and Expires 3/1/13.
 
4.  PLANNED CONTRACT MODIFICATION
This ordinance authorizes funding for part 1 of this design contract.  A planned modification will be executed at the completion of part 1 to complete the design of the project.
 
5. FISCAL IMPACT:
Funding for the Department of Public Service portion of this contract in the amount of $101,957.99 is budgeted in the 2012 C.I.B. and available within the Streets and Highways G.O. Bonds Fund.  Funding for the Department of Recreation and Parks in the amount of $101,957.98 is available within the Voted Recreation and Parks Bond Fund 702.
 
6.  EMERGENCY DESIGNATION
Emergency action is requested to provide funding for the professional services described above at the earliest possible time to provide for design work for this project and pedestrian improvements for at the earliest possible time.

WHEREAS, there is a need to provide professional engineering services for the design of the Bridge and Trail Improvements - West Fifth Avenue from McKinley Avenue to Dublin Road project; and
WHEREAS, this project involves preliminary and final engineering for a wider Fifth Avenue bridge over the Scioto River and an extension of the Scioto Trail between Dublin Road and McKinley Avenue along with incidental or complete street improvements; and
WHEREAS, The Department of Public Service, Office of Support Services solicited Requests for Proposals for this project; and
 
WHEREAS, Glaus, Pyle, Schomer, Burns & Dehaven, Inc, received the highest score by the evaluation committee and will be awarded the contract for this project; and
WHEREAS, design will proceed in two parts with Part 1 consisting of preliminary engineering, geotechnical investigation, surveying, and preliminary environmental investigations; and
 
WHEREAS, the specific scope of work for Part 2 will be developed upon completion of Part 1 and will generally consist of final engineering, environmental clearance, and construction plan production; and
 
WHEREAS, a planned modification will occur at the completion of part 1 of the project to fund work needed to complete part 2; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, in that this legislation should go forth immediately to provide funding for these engineering services to provide project design services for pedestrian and travelling public improvements at the earliest possible time, thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That the Director of Public Service be and hereby is authorized to enter into a professional services contract with Glaus, Pyle, Schomer, Burns & Dehaven, Inc, 1801 Watermark Drive, Suite 150, Columbus, OH, 43215, for engineering services associated with the Bridge and Trail Improvements - West Fifth Avenue from McKinley Avenue to Dublin Road project.
 
SECTION 2.  That the 2012 Capital Improvement Budget established within ordinance 0368-2012 be and hereby is amended as follows:

SECTION 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 6.  All funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated.
 
SECTION 7.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
