Explanation
1.  BACKGROUND:  This legislation authorizes the Director of Public Utilities to modify the City Auditor's Contract No. EL000648 with the Complete General Construction Company for the Norwood Street Drainage Improvements Project.  This modification is required to adjust the final project contract pay items to those actually used in the field.
 
2.  CONSTRUCTION CONTRACT MODIFICATION:  The amount of this contract modification is $84,408.04.  The contract total, including this modification is $1,162,193.79.  Based upon actual construction and field conditions, new items were necessary for the successful completion of the subject project.  This additional work was a direct, logical extension of the work included in the original contract and it was not deemed either feasible or reasonable to suspend work with the entity under contract and undertake continuation of the work under a new procurement.  The prices contained within this contract modification were deemed reasonable by Division of Transportation inspection personnel, and have subsequently been agreed to by the contractor.
 
3.  EMERGENCY DESIGNATION:  The Division of Sewerage and Drainage is requesting City Council to declare this legislation an emergency measure so that payment can be made to the contractor for additional work that was required in order to successfully complete the project.  
 
4.  FISCAL IMPACT:  This ordinance further requests the transfer of residual funds from within the Storm Sewer Bond Fund for purposes of providing funding for this expenditure.

Body
WHEREAS, Contract No. EL000648, was authorized by Ordinance No. 1744-00, as passed July 17, 2000, executed August 9, 2000, and approved by the City Attorney on August 11, 2000, for purposes of authorizing the Director of Public Utilities to enter into contract with the Complete General Construction Company, Inc., for the construction of the  Norwood Street Drainage Improvements Project; and
 
WHEREAS, the work performed under the aforementioned construction contract has been accepted by the City of Columbus and final contract item quantities have been agreed upon by the City and the Complete General Construction Company; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, in that it is necessary to authorize the Director of Public Utilities to modify the subject contract, pursuant to the immediate payment of outstanding items that were necessary to successfully complete the construction of the Norwood Street Drainage Improvements Project; to authorize the transfer of funds within the Storm Sewer Bond Fund; and to amend the 2003 Capital Improvement Budget as required to fund the subject expenditure; for the preservation of the public health, peace, property and safety; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the City Auditor is hereby authorized and directed to transfer $84,408.04 within the Storm Sewer Bond Fund, in order to fund the Norwood Street Drainage Improvements Project, as follows:

Section 2.  That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.
 
Section 3.  That the Director of Public Utilities be, and hereby is, authorized to modify Contract No. EL000648 with Complete General Construction Company; 1221 East Fifth Avenue; Columbus, Ohio 43219; for construction of the Norwood Street Drainage Improvements project in accordance with the terms and conditions shown on the contract on file in the Stormwater Program Office of the Division of Sewerage and Drainage.
 
Section 4.  That for the purpose of paying the cost of the said contract modification, the following expenditure, or as much thereof as may be needed, be and the same is hereby authorized from the Storm Sewer Bond Fund| Fund No. 685| Div.: 60-15| Project 610933| Norwood St. Drainage Improvements Project| OCA Code 685933| Object Level Three 6621| Amount $84,408.04.
 
Section 5.   That the 2003 Capital Improvements Budget Ordinance No. 1943-2003 is hereby modified as follows, to provide sufficient budget authority for the execution of the modification of the construction contract stated in Section 3 herein.

Section 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
