Explanation

 

Council Variance Application: CV24-085

 

APPLICANT:  Courtney Walker, c/o Tiffany Kroninger, Agent; 97 Vaughn Road; Delaware, OH 43015.

 

PROPOSED USE:  Barber shop, beauty salon, and nail salon uses.

 

CITY DEPARTMENTS' RECOMMENDATION:  Approval. The site consists of one parcel developed with a commercial office building in the CPD, Commercial Planned Development District as allowed by Ordinance #0497-85 (Z84-138; Sub-Area 2), passed on March 18, 1985. The requested variance will allow barber shop, beauty salon, and nail salon uses, with other ancillary personal spa and salon services in Unit A of the existing commercial building. A Council variance is required because this subarea of the CPD district only allows office and institutional uses. No other variances are included in this request. The site is within the planning boundaries of the Far North Area Plan (2014), which recommends “Mixed Use (Community)” land uses at this location, consistent with the request. Since the primary use of the property will remain commercial, and will not introduce an incompatible use to the area, Staff recommends approval.

To grant a Variance from the provisions of Sections 3349.03, Permitted uses; 3353.03, C-2 Permitted uses; and 3361.02, Permitted uses, of the Columbus City Codes; for the property located at 117 LAZELLE RD. (43235), to allow barber shop, beauty salon, and nail salon uses in the CPD, Commercial Planned Development District (Council Variance #CV24-085).

 

Body

 

WHEREAS, by application #CV24-085, the owner of property at 117 LAZELLE RD. (43235), is requesting a Council variance to allow barber shop, beauty, and nail salon uses in the CPD, Commercial Planned Development District; and

 

WHEREAS, by Ordinance #0497-85 (Rezoning Application Z84-138), the CPD, Commercial Planned Development District only permits uses of the I, Institutional District and C-2, Commercial District; and

 

WHEREAS, Section 3349.03, Permitted uses, does not allow barber shop, beauty salon, and nail salon uses, while the applicant proposes to operate barber shop, beauty salon, and nail salon uses in Unit A of the existing building; and

 

WHEREAS, Section 3353.03, C-2 Permitted uses, does not allow barber shop, beauty salon, and nail salon uses, while the applicant proposes to operate barber shop, beauty salon, and nail salon uses in Unit A of the existing building; and

 

WHEREAS, Section 3361.02, Permitted uses, specifies I, Institutional and C-2, Commercial district uses, and does not allow barber shop, beauty, and nail salon uses, while the applicant proposes to operate barber shop, beauty salon, and nail salon uses in Unit A of the existing building; and

 

WHEREAS, the City Departments recommend approval because the request is consistent with the Far North Area Plan and will not introduce an incompatible use to the area; and

 

WHEREAS, said ordinance requires separate submission for all applicable permits and Certificate of Occupancy for the proposed use; and

 

WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and

 

WHEREAS, the granting of said variance will not impair an adequate supply of light and air to the adjacent property, unreasonably increase the congestion of public streets, increase the danger of fires, endanger the public safety, unreasonably diminish or impair established property values within the surrounding area, or in any other respect impair the public health, safety, comfort, morals or welfare of the inhabitants of the City of Columbus; and

 

WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owner of the property located at 117 LAZELLE RD. (43235) in using said property as desired; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That a variance from the provisions of Sections 3349.03, Permitted uses; 3353.03, C-2 Permitted uses; and 3361.02, Permitted uses, of the Columbus City Codes; is hereby granted for the property located at 117 LAZELLE RD. (43235), insofar as said sections prohibit barber shop, beauty salon, and nail salon uses in Subarea 2 of the CPD, Commercial Planned Development District; said property being more particularly described as follows:

 

117 LAZELLE RD. (43235), being 0.05± acres located at the southwest corner of Lazelle Road and Lazelle Road East, and being more particularly described as follows:

 

Situated in the State of Ohio, County of Franklin and in the City of Columbus:

 

Being Unit A of the Lazelle Road Building Condominium, as the same is numbered and delineated in the Declaration thereof, of record in Official Record 08465, Page H-14, as amended in Official Record Volume 8958, Page G18 and as amended in Official Record Volume 11172, Page A-04, and the Drawings thereof, which drawings are recorded in Condominium Map Records Volume 36, Page 53, all in the records of the Recorder, Franklin County, Ohio.

SECTION 2.  That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for barber shop, beauty salon, and nail salon uses, including other ancillary personal spa and salon services, limited to Unit A; and/or those uses allowed by the CPD, Commercial Planned Development District on this property as approved by Ordinance #0497-85 (Z84-138; Sub-Area 2).

 

SECTION 3.  That this ordinance is further conditioned upon the applicant obtaining all applicable permits and a Certificate of Occupancy for the proposed use.

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
