PROPOSED USE:  Multi-family housing for the elderly.

 

DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (6-0) on May 6, 2004.

 

CLINTONVILLE AREA COMMISSION RECOMMENDATION:  Approval.

 

CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The requested CPD, Commercial Planned Development District to develop multi-family senior housing is consistent with surrounding zoning and development patterns.  The CPD text limits permitted uses to Home for the Aging, Nursing Home, Rest Home or Housing for the Elderly as permitted in C.C. 3349.03 and establishes development standards to limit the number of dwelling units to 47, establish minimum side and rear yards and parking and maneuvering setbacks along the west property line, establish maximum building height, interior parking lot landscaping, landscaped screening along the east property line adjacent to single-family residential development, use of brick except for accents, gutters and eaves, a minimum 6/12 roof pitch with fully dimensional shingles, and provides lighting and graphics restrictions.  Variances are requested to allow two (2) more dwelling units than permitted per C.C. 3349.03(w) and to allow a facility without frontage on a public right-of-way to be served by a permanent easement to Morse Road.

WHEREAS, application #Z04-007 is on file with the Building Services Division of the Department of Development requesting rezoning of 2.5± acres, From:  R-4, Residential District, To:  CPD, Commercial Planned Development District; and

 

WHEREAS, the Clintonville Area Commission recommends approval of said zoning change; and

 

WHEREAS, the Development Commission recommends approval of said zoning change; and

 

WHEREAS, the Clintonville Area Commission recommends approval of said zoning change; and

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

 

118 MORSE ROAD (43214), being 2.5± acres located on the north side of Morse Road, 485± feet north of Morse Road and 184± feet east of Arbor Village Drive, and being more particularly described as follows:

 

DESCRIPTION OF 2.505± ACRES

 

Situated in the City of Columbus, County of Franklin, State of Ohio; being in Quarter Township 3, Township 2, Range 18, United State Military Lands, and being part of Farm Lot No. 18, Scioto Company=s Subdivision; also being a part of those lands conveyed to North Community Evangelical Lutheran Church as described in Deed Book 1481 Page 891, Deed Book 1550 Page 247, Deed Book 2008 Page 92, and Deed Book 2365 Page 248,; and being more particularly described as follows,

 

Commencing at the intersection of the centerline of Morse Road and the centerline of Arbor Village Drive; thence along the centerline of Morse Road South 86 degrees 00' 00" East two hundred six and fifty one-hundredths feet (206.50') to a point, said point being the southwesterly corner of those lands of said North Community Evangelical Lutheran Church; thence,

SECTION 2.  That a Height District of sixty (60) feet is hereby established on the CPD, Commercial Planned Development District on this property.

1.  INTRODUCTIONThe proposed development is a building of independent living elderly units to the rear of an existing Lutheran Church.

 

2.  PERMITTED USES: The only permitted uses shall be Home for the Aging, Nursing Home, Rest Home or Housing for the Elderly as shown in Chapter 3349, I, Institutional of the Columbus City Code.

 

3.  DEVELOPMENT STANDARDSUnless otherwise indicated in the submitted site plan or written text, the applicable development standards are contained in Chapter 3349, I-Institutional District of the Columbus City Code.

 

A.  Density, Height, Lot and/or Setback commitments.

 

1.  The maximum number of independent living units shall be 47.

 

2.  Rear yard and side yard setbacks shall be 30'.

 

3.  Parking lot and maneuvering lane setbacks shall be 10' from side yard on the western side of the property as shown on the site plan.

 

4.  The maximum height for the site shall be forty (40)feet unless varied by the Board of Zoning Appeals.

 

B.  Access, Loading, Parking and/or other Traffic related commitments.

 

1.  The access to the development shall be provided via a permanent easement over the Church property from the existing eastern most curbcut on Morse Road which serve the Church facility.  The proposed development will have no frontage on a publicly dedicated right of way.

 

C.  Buffering, Landscaping, Open space and/or Screening commitments.

 

1.  One tree shall be planted, within and around the parking areas, for every 10 parking spaces.

 

2.  All trees shall meet the following minimum size at the time of planting unless otherwise indicated.

 

Shade trees 3.0" caliper

Ornamental Trees 1 1/2" caliper

Evergreen Trees 6 feet in height

 

3.  All trees and landscaping shall be well maintained.  Dead items shall be replaced within six months.

 

4.  A line of evergreen trees shall be planted fifteen (15) feet on center along the eastern property line to provide a buffer for those homes which abut the site.

 

D.  Building design and/or Interior-Exterior treatment commitments.

 

1.  The building shall be built of brick with a variety of materials permitted for accents, eaves and gutters.

 

2.  The roof shall have a slope pitch of a minimum 6/12 and the roof shall be constructed of fully dimensional shingles.

 

E.  Dumpsters, Lighting, Outdoor display areas and/or other environmental commitments.

 

1.  All external outdoor lighting shall be cut-off fixtures (except that the developer may use coach lighting around the building in pedestrian and patio areas) and shall be designed and placed to prevent spillage of light off the site and to prevent glare visible from the property lines.

 

2.  Except for decorative lighting, all other light poles shall be metal and such light poles shall be of the same color. Light poles in the parking lots shall not exceed 18 feet in height.

 

3.  Wiring within the subject site shall be underground, unless a utility company providing service through or over the property prohibits under ground installation.

 

4.  Any ground level exterior mechanical equipment or dumpster shall be screened from off site viewing to a height of six feet with a wall, fence, landscaping individually or in any combination thereof.

 

F.  Graphics and Signage commitments.

 

1.  Any free standing graphic shall be a monument style graphic.  All other graphics standards shall be those standards contained in Article 15 of the Columbus City Code as it applies to the I, Institutional District.  Any variance to said standards hall be obtained from the Graphics Commission.

 

G.  Miscellaneous commitments.

 

1.  At the time of filing for a certificate of zoning clearance the applicant shall pay the required park fee to the City of Columbus.

 

2.  The site shall be developed in substantial compliance with this CPD text and the site plan submitted herewith, titled "LSS NORTH COMMUNITY SENIOR HOUSING, COLUMBUS, OHIO:  C101, "signed by Jackson B. Reynolds, III, Attorney for the Applicant on March 24, 2004.

 

3.  The Zoning Site Plan may be slightly adjusted to reflect engineering, topographical, or other site data developed at the time of the development and when engineering plans are completed.  Any slight adjustment to the Zoning Site Plan shall be reviewed and approved by the Director of the Department of Development, or his designee, upon submission of the appropriate data regarding the proposed adjustment.

 

 

H.  CPD Requirements.

 

1.  NATURAL ENVIRONMENT:  The site is undeveloped and is located to the rear of the existing Church.

 

2.  EXISTING LAND USES:  To the west and north are Multi-family residential housing; to the east single-family homes and duplexes; and to the south is the existing church.

 

3.  TRANSPORTATION AND CIRCULATION:  Access to the site shall be via the existing eastern most curbcut for the Church on Morse Road.

 

4.  VISUAL FORM OF THE ENVIRONMENT:  The proposed development is a multi story independent living elderly development.

 

5.  VIEW AND VISIBILITY:  In the development of the subject property and in the location of the buildings and access points, consideration has been given to the visibility and safety of the motorist and pedestrian.

 

6.  PROPOSED DEVELOPMENT:  Independent living elderly housing development.

 

7.  EMISSIONS:  No adverse affect from emissions shall result form the proposed development.

 

8.  BEHAVIOR PATTERNS:  The existing developments have established both behavior and transportation patterns.  The proposed development will provide alternative housing opportunities for the elderly.

 

I.  Variances Requested.

 

1.  The proposed facility will have no frontage on a public right-of-way.  The facility will be accessed by a permanent easement from Morse Road back to the 2.5" acre site.

 

2.  The facility will contain 47 units which is 2 units more than permitted in Columbus City Code Section 3349.03(W).

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
