BACKGROUND: This ordinance authorizes the Public Utilities Director to modify an existing contract with ABB, Inc. for the Division of Electricity for the Italian Village Substation to change the design of the GIS bus runs from overhead to underground.
Amount of additional funds to be expended: $89,100.00 (Original Contract Amount: $6,816,910)
Reasons additional goods/services could not be foreseen: The GIS bus runs were originally designed to be overhead, however, the supports for the overhead did not provide access to the existing site for maintenance, therefore, a modification to change the GIS bus runs to underground is requested.
Reason other procurement processes are not used: ABB, Inc. was awarded the original contract for the Italian Village Substation project based upon the lowest bid received March 3, 2004. It would not be feasible to bid this work separately and would cause a delay in the project.
How cost of modification was determined: A written estimate was provided by ABB, Inc.

Emergency action is requested in order to continue with the design and to keep the project on schedule.
FISCAL IMPACT: There is sufficient funding in the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund 553, Italian Village Substation Project 670607 for this expenditure.

To authorize the Director of Public Utilities to modify an existing contract for the Division of Electricity with ABB, Inc. for the Italian Village Substation to change the GIS bus runs from overhead to underground; to authorize the expenditure of $89,100.00 from the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund; and to declare an emergency. ($89,100.00)

WHEREAS, bids were solicited and opened on March 3, 2004 to build an electrical substation in the Italian Village area; and
WHEREAS, the Public Utilities Director, under the authority of Ordinance 0934-2004, passed July 19, 2004, has entered into contract EL004478, with ABB, Inc. based upon the lowest responsive and responsible bid received; and
WHEREAS, it is necessary to change the original design of the GIS bus runs from overhead to underground to provide space for access to the existing site for maintenance; and
WHEREAS, emergency action is necessary to avoid unnecessary delay in the project; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Utilities, Division of Electricity, in that it is immediately necessary to modify the existing contract with ABB, Inc. for the Italian Village Substation for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Public Utilities Director is hereby authorized and directed to modify an existing contract with ABB, Inc. for the Italian Village Substation to change the design of the GIS bus runs from overhead to underground and to increase the contract by an amount of $89,100.00.
SECTION 2. That this contract modification is in compliance with Section 329.13 of Columbus City Codes, 1959.
SECTION 3. That to pay the cost of the aforesaid contract modification, the expenditure of $89,100.00, or so much thereof as may be needed, is hereby authorized from the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund 553, Division No. 60-07, Italian Village Substation Project Number 670607, OCA Code 670607, Object Level Three 6621.
SECTION 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
