Explanation
 
BACKGROUND:  Need. This legislation authorizes the Director of Public Utilities to enter into an agreement with M E Companies for professional engineering services for the Canyon Drive/Glenmont Avenue Area Stormwater System Improvements Project. This project has been developed to mitigate frequent street and yard flooding along Glenmont Avenue, Canyon Drive and Yaronia Drive in the Overbrook Ravine Area.
 
Bid Information. The selection of the firm providing the professional engineering services has been performed in accordance with the procedures set forth in Columbus City Code, Section 329.11, "Awarding professional service contracts through requests for statements of qualifications." A notice of Request for Statements of Qualifications appeared in the City Bulletin on February 22 and March 1, 2003.  Statements of Qualifications were received on March 7, 2003.  Forty-seven consultants submitted Statements of Qualifications. Three consultants were selected to submit technical proposals for this project.  All three consultants submitted these technical proposals on July 3, 2003.
 
Upon review of the Statements of Qualifications and technical proposals, the offerors have been ranked using criteria specified in City Code, and other criteria, specifically: competence of the offeror to perform the service, past performance of the offeror, cost evaluation, the feasibility/quality of the proposed project approach, location of the office to perform the work, familiarity with local project requirements, ability to perform expeditiously, and contracted backlog of work with the Division.
 
Based upon these criteria, M E Companies was selected as the highest-ranked offeror.

FISCAL IMPACT:  This fund transfer from the Special Income Tax Fund to the Storm Sewer Bond Fund is a temporary measure, until such time as the proceeds from the bond sale can be made available.  In addition, this legislation amends the 2003 Capital Improvements Budget for purposes of establishing sufficient budget authority for this expenditure.

Body
 
WHEREAS, it is necessary to transfer and appropriate money from the Special Income Tax Fund to the Storm Sewer Bond Fund; and
 
WHEREAS, the City will sell notes or bonds for the Canyon Drive/Glenmont Avenue Area Stormwater System Improvement Project and will reimburse the Special Income Tax Fund, this transfer should be considered as a temporary funding method; and
 
WHEREAS, the aggregate principal amount of obligations which the City will issue to finance the project is presently expected not to exceed $102,170.02; and
 
WHEREAS, it is necessary to authorize an amendment to the 2003 Capital Improvements Budget for purposes of providing sufficient funding and spending authority for the aforementioned project expenditure; and
 
WHEREAS, significant flooding and other stormwater problems have been identified through customer complaints for the area covered by this project; and
 
WHEREAS, it is necessary to authorize the Director of Public Utilities to enter into an agreement for professional engineering services to mitigate the significant flooding and other stormwater problems; now therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the sum of $102,170.02 be and hereby is appropriated from the unappropriated balance of the Special Income Tax Fund, Fund 430, and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ending December 31, 2004, to the City Auditor, Department No. 22-01, Object Level One Code 10, Object Level Three Code 5502 and OCA Code 902023.
 
Section 2.  That the City Auditor is hereby authorized to transfer said funds to the Storm Sewer Bond Fund at such time as is deemed necessary by the City Auditor and to expend said funds, or so much thereof as may be necessary.
 
Section 3.  That the amount of $102,170.02 be and hereby is appropriated to the Storm Sewer Bond Fund, Fund 685, for the Division of Sewerage and Drainage, Department No. 60-15, Object Level One 06, Object Level Three Code 6682, Project 610749, OCA Code 685749.
 
Section 4.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
Section 5.  That upon obtaining other funds for the Canyon Drive/Glenmont Avenue Area Stormwater System Improvement Project, the City Auditor is hereby authorized to repay the Special Income Tax Fund the amount transferred under Section 2 above, and said funds are hereby deemed appropriated for such purpose.
 
Section 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for any contract or contract modification associated with expenditure of the funds transferred in Section 2, above.
 
Section 7.  That the City intends that this ordinance constitute an "official intent" for purposes of Section 1.150-2(e) of the Treasury Regulations promulgated pursuant to the Internal Revenue Code of 1986, as amended.
 
Section 8.  That the Director of Public Utilities be, and hereby is, authorized to execute an agreement with M E Companies, 635 Brooksedge Boulevard, Westerville, Ohio 43081 for the Division of Sewerage and Drainage, for professional engineering services in accordance with the terms and conditions on file in the office of the Division of Sewerage and Drainage.
 
Section 9. That the said engineering firm shall conduct the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Sewerage and Drainage.
 
Section 10. That for the purpose of paying the cost of the professional engineering services contract, the following expenditure, or as much thereof as may be needed, be and the same is hereby authorized as follows:  Division 60-15, Fund 685, Project 610749, Object Level Three 6682, OCA Code 685749, Amount $102,170.02.
 
Section 11.  That the 2003 Capital Improvements Budget, Ordinance No. 1943-2003 is hereby modified as follows, to provide sufficient budget authority for the execution of the engineering agreement stated in Section 8 herein:

Section 12. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance shall take effect and be in force from and after the earliest date allowed by law.
