Title: To authorize the Director of Public Utilities to submit applications for grants, credit enhancements and loans, to the District Three Public Works Integrating Committee and the Ohio Public Works Commission, for three Division of Sewerage and Drainage Capital Improvement Projects, and to declare and emergency.
 
 
Explanation
 
1.  BACKGROUND
 
NEED: The District Three Public Works Integrating Committee and the Ohio Public Works Commission requires this legislation which authorizes the Director of Public Utilities to submit applications for grants, credit enhancements and loans for capital infrastructure improvement projects.  
 
2.  FISCAL IMPACT:    N/A
 
3.  EMERGENCY DESIGNATION:  The City is required to submit a copy of approved legislation authorizing the Director of the Department of Public Utilities to apply for financial assistance from the state of Ohio Public Works Commission before the application for assistance can be evaluated.  The deadline for applications is September 11, 2006.  This legislation must be passed on or before that date.

To authorize the Director of Public Utilities to submit applications for grants, credit enhancements and loans, to the District Three Public Works Integrating Committee and the Ohio Public Works Commission, for three Division of Sewerage and Drainage Capital Improvement Projects, and to declare and emergency.
 
Body
 
WHEREAS, pursuant to Article VIII, Section 2K of the Ohio Constitution, the State of Ohio is authorized to issue bonds and other obligations of the state for the purpose of financing public infrastructure capital improvements of political subdivisions as designated by law; and
 
WHEREAS, pursuant to Section 164.06 of the Ohio Revised Code, the District Three Public Works Integrating Committee has been created to accept, evaluate and recommend applications for state financing of capital infrastructure improvement projects of political subdivisions in Franklin County; and
 
WHEREAS, pursuant to Section 164.05 of the Ohio Revised Code, the Ohio Public Works Commission has been created to accept and approve applications for state financing of capital infrastructure improvement projects of political subdivisions in Franklin County; and
 
WHEREAS, the City of Columbus Department of Public Utilities has conducted a capital inventory and needs assessment as part of the Wet Weather Management Plan designed to meet the requirements of two consent actions filed with the state of Ohio and has determined that it is necessary to submit applications for financial assistance for capital infrastructure improvement projects; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, in that it is immediately necessary to authorize the Director of Public Utilities to apply for financial assistance from the state of Ohio Public Works Commission so that the application for assistance can be submitted in time to meet the application deadline; NOW THEREFORE:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Director of Public Utilities be, and hereby is, authorized to submit applications for grants, credit enhancements and loans to the District Three Public Works Integrating Committee and the Ohio Public Works Commission for the following capital infrastructure improvement projects:
 
1.   CIP No. 650364, Southerly Wastewater Treatment Plant (SWWTP), Headworks, Part 2
2.   CIP No. 650366, Southerly Wastewater Treatment Plant (SWWTP), Final Clarifier Additions and Improvements
3.   CIP No. 650577, Hilock/Lewis Roads Assessment Sewer  
 
Section 2.  The Director of Public Utilities is further authorized to enter into any agreements as may be necessary and appropriate for obtaining this financial assistance in conjunction with the recommendations of the Wet Weather Management Plan and the Administrator of the Division of Sewerage and Drainage, and approved as to form by the City Attorney, in accordance with all authority granted to and limitations upon by the Auditor of the City of Columbus.
 
Section 3.  That for the reasons stated in the preamble hereto, which is made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
