Explanation
1.  BACKGROUND
This legislation authorizes the Director of Public Service to enter into contract in an amount up to $220,586.18 for the Pedestrian Safety Improvements - Obetz Road Sidewalk Project and to pay construction inspection costs up to $55,146.55.
 
This project will construct 2,662 linear feet of sidewalk on Obetz Road between South High St. and Beth Ann Drive, including miscellaneous drainage improvements, pavement replacement at the intersection of Obetz Road and South High Street, and curb ramp improvements and driveway replacements.  Concrete sidewalk with a width of 5 feet along both sides of the road and a total of 3 wheelchair ramps will be built.  There are 7 bus stops and transit routes within the limits of this project.  
Pedestrian generators and destinations impacting the proposed project include Children's Academy, CHN Housing on Southpointe Blvd, a church and senior housing facility.
The estimated Notice to Proceed date is estimated to be May 2, 2011.  The estimated completion date is July 26, 2011.  The project was let by the Office of Support Services through vendor services.  6 bids were received on March 17, 2011 (6 majority, 0 minority) and tabulated on March 18, 2011 as follows:

Award is to be made to Decker Construction Company, as the lowest, best, most responsive and most responsible bidder.
 
Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Decker Construction Company.   
 
2.  CONTRACT COMPLIANCE
Decker Construction Company's contract compliance number is 310983557 and expires 10/20/11.
 
3.  FISCAL IMPACT
The amount of the contract and inspection for this project is $275,732.73.  The City will be funding 20% of the project and the remainder will be funded by a New Freedom grants.  
 
4.  EMERGENCY DESIGNATION
Emergency action is requested to facilitate the completion of the project this construction season and to make these sidewalks available to pedestrians as early as possible.

Body
WHEREAS, bids were received on March 17, 2011 and tabulated on March 18, 2011, for the Pedestrian Safety Improvements - Obetz Road Sidewalks Project and a satisfactory bid has been received; and
 
WHEREAS, it is necessary to provide for construction inspection costs; and
 
WHEREAS, the Department of Public Service applied for and received a New Freedom Grant for this project; and
 
WHEREAS, On September 17, 2008 Ordinance 1307-2008 was passed to enter into a grant agreement with COTA and accept New Freedom grant funds.
 
WHEREAS, on September 14, 2009 Ordinance 1031-2009 was passed to enter into a grant agreement with COTA and accept additional grant funds for the Pedestrian Safety Improvements - Obetz Road Sidewalks.
 
WHEREAS, these grants will be utilized to provide 80% of the funding for this project; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Mobility Options, in that it is necessary to expedite the commencement of this project in order to construct the project this construction season and make these sidewalks available to the public to provide a safe walking area, thereby preserving the public health, peace, property, safety and welfare, now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public Service be and is hereby authorized to enter into a contract with the Decker Construction Company, 3040 McKinley Avenue, Columbus, OH 43204, for the construction of the Pedestrian Safety Improvements - Obetz Road Sidewalks Project in the amount of $220,586.18, for the Division of Mobility Options in accordance with the specifications and plans on file in the Office of the Support Services, which are hereby approved; and to obtain and pay for the necessary inspection costs associated with this project up to a maximum of $55,146.55.
 
SECTION 2.  That the transfer of cash and appropriation within fund 746, The Build America Bonds Fund be authorized as follows:

SECTION 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 7.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
