AN06-009
BACKGROUND:      This ordinance is submitted to present to Council the transcript of proceedings and papers relating to Annexation AN06-009 a certain petition for annexation as described in the ordinance which is attached hereto. More than sixty days have elapsed since August 16, 2006, the date of receipt from the Board of County Commissioners of Franklin County.
 
These are submitted in accordance with the Ohio Revised Code.
 
FISCAL IMPACT:      Provision of municipal services for a proposed annexation area has no fiscal impact.  However, provision of the stated services does represent cost to the city.  The annexation of land also has the potential to create revenue to the city.

To accept the application (AN06-009) of North East Community Baptist Church for the annexation of certain territory containing 4.8 ± Acres in Plain Township.
 
Body
 
WHEREAS,   a petition for the annexation of certain territory in Plain Township was duly filed by North East Community Baptist Church on July 5, 2006; and
 
WHEREAS,  the said petition was duly considered by the Board of County Commissioners of  Franklin County, Ohio, and the annexation of said hereinafter described territory to the city of Columbus was approved by said Commissioners by order dated August 1, 2006; and
WHEREAS,  the Board of County Commissioners of  Franklin County certified the transcript of the proceedings in connection with the said annexation with the map and petition required in connection therewith to the City Clerk who received the same on August 16, 2006; and
WHEREAS,  sixty days from the date of said filing have now elapsed in accordance with the provisions of the Ohio Revised Code; and
 
WHEREAS,  it is in the best interest of the city of Columbus to accept the annexation of the territory sought to be annexed by the aforesaid petition; now, therefore,  
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
 
Section 1.  That the proposed annexation as applied for in the petition of North East Community Baptist Church being the majority of owner(s) of real estate in the territory sought to be annexed and filed with the Board of County Commissioners of Franklin County, Ohio July 5, 2006 in which said petition prayed for annexation to the city of Columbus, Ohio, of certain territory adjacent thereto as hereinafter described, and which said petition was approved for annexation to the city of Columbus by the Board of County Commissioners by order dated August 1, 2006, be and the same is hereby accepted and said territory is hereby annexed to the city of Columbus.  Said territory is described as follows:
 
Situated in the State of Ohio, County of Franklin, Township of Plain, being in the Southwest Quarter of Section 7, Township 2, Range 16, United States Military Lands, being a 4.8 acre tract of land that lies over and across a 5.0 acre tract of land described in deed to Northeast Community Baptist Church of record in Instrument Number 200212020307176, and being more particularly described as follows:
 
COMMENCING for reference at the centerline intersection of Central College Road and the centerline of Harlem Road being the southeasterly corner of a 2.268 acre tract of land described in deed to Sandro Treonze and Pasquale Giammarco of record in Instrument Number 200501140009737;
 
Thence South 86°30'00" East with the centerline of said Central College Road and the southerly line of said 2.268 acre tract, a distance of approximately 336 feet to a point at the southwesterly corner of said 5.0 acre tract and the southeasterly corner of said 2.268 acre tract;
 
Thence North 03°25'00" East crossing said Central College Road with the easterly line of said 2.268 acre tract and the westerly line of said 5.0 acre tract, a distance of approximately 30 feet to a point on the northerly right of way line of said Central College Road, being the existing City of Columbus Corporation Line by Ordinance Number 1673-2004, and being the TRUE POINT OF BEGINNING of the tract to be described;
 
Thence North 03°25'00" East with the westerly line of said 5.0 acre tract, the easterly line of said 2.268 acre tract, the easterly line of a 1.438 acre tract of land described in deed to Sandro Treonze and Pasquale A. Giammarco of record in Instrument Number 200510210222509, the easterly line of a 1.533 acre tract of land described in deed to James W. Bryant of record in Instrument Number 200211010278107, and the easterly line of a 2.36 acre tract of land described in deed to Ruth P. Whittington of record in Instrument Number 199904260102788, a distance of approximately 630 feet to a point at the northwesterly corner of said 5.0 acre tract and being on the southerly line of a 78.0 acre tract of land described in deed to Albert and Helen I. Vesner, Co-Trustees of record in Instrument Number 199910010246966;
 
Thence South 86°35'00" East with the northerly line of said 5.0 acre tract and the southerly line of said 78.0 acre tract, a distance of approximately 330 feet to a point at the northeasterly corner of said 5.0 acre tract and being the northwesterly corner of a 5.052 acre tract of land described in deed to Carl W. Shye Jr. and Deborah S. Shye of record in Official Record 28668E05;
 
Thence South 03°25'00" West with the easterly line of said 5.0 acre tract and the westerly line of said 5.052 acre tract, a distance of approximately 630 feet to a point on the northerly right of way line of said Central College Road and said existing City of Columbus Corporation Line;
 
Thence North 86°35'00" West with said line and crossing said 5.0 acre tract, a distance of approximately 330 feet to the TRUE POINT OF BEGINNING and containing 4.8 acres of land, more or less.
 
Total perimeter of annexation area is 1920 feet, of which 330 feet is contiguous with the City of Columbus by Ordinance Number 1673-2004, giving 17% perimeter contiguity.
 
Section 2.  That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.
 
Section 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
