Explanation
 
In 1997, the City of Columbus acquired approximately 74 acres +/- of real property located in the vicinity of Spindler Road and Summerlawn Drive, and commonly known as Spindler Park, for the purpose of providing an active recreation area to the surrounding community.  The City purchased all but two out lots with intentions to acquire those remaining properties at a later dater in order to complete the park's entire boundaries.  The City now desires to purchase one of the remaining out lots identified as 2095 Spindler.  After investigation by the Department of Recreation and Parks, it has been determined that this acquisition will further consolidate the park properties, relieve possible proximity issues with residential homes, and improve park programming.  The following legislation authorizes entering into  a purchase agreement and any ancillary documents for the acquisition of 2095 Spindler Road.
 
Fiscal Impact
      $176,000.00 is required and budgeted in the Special Purpose Fund to meet the financial obligation of this contract.

Body
 
WHEREAS, in 1997 the City of Columbus acquired approximately 74 acres +/- of real property, located in the vicinity of Spindler Road and Summerlawn Drive, and commonly known as Spindler Park, for the purpose of providing an active recreation area to the surrounding community; and
 
WHEREAS, the City purchased all but two out lots with intentions to acquire those remaining properties at a later date in order to complete the park's entire boundaries; and
 
WHEREAS, the City now desires to purchase one of the remaining out lots identified as 2095 Spindler; and
 
WHEREAS, Donald W. Kidd, II, owner, desires to sell the property to the City; and
 
WHEREAS, after an investigation by the Department of Recreation and Parks, it has been determined that this acquisition will further consolidate the park properties, relieve possible proximity issues with residential homes, and improve park programming; and
 
WHEREAS, an emergency exists in the usual daily operation of the City of Columbus, in that it is immediately necessary to authorize the Director of the Recreation and Parks Department to executive those documents necessary for the purchase of said real property for the immediate preservation of the public health, peace, property and safety; NOW THEREFORE,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1. That the Director of Recreation and Parks Department be, and hereby is authorized to execute those documents as approved by the City Attorney's Office, Real Estate Division, necessary to enter into a purchase contract with Donald W. Kidd, II, owner, for the purchase of that real property known as 2095 Spindler Road, Columbus, Ohio.
 
            Section 2.   That the expenditure of $176,000.00, or so much thereof as may be necessary, be and is hereby authorized from the Special Purpose Fund No. 223, Dept. 51-01, Subfund 025, Object Level 3 - 6601, and OCA Code 511220.
 
            Section 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or 10 days after passage if the mayor neither approves nor vetoes the same.
