Explanation
 
1.  BACKGROUND:  This legislation authorizes the Director of Public Utilities to execute a contract with Kokosing Construction Company, Inc., for the construction of the Clintonville Main Rehabilitation Project.  This project will repair and rehabilitate approximately 2,798 lineal feet of 24-inch diameter, 6,736 lineal feet of 30-inch diameter, and 3,163 lineal feet of 36-inch diameter sanitary sewer lines, utilizing Cured-in-Place Pipe (CIPP).  The work includes cleaning, video inspection lateral sewer reestablishment, bypass pumping, traffic maintenance, open cut point repairs, and other associated work.  This project also includes the installation of a small section of storm sewer off of Olentangy Blvd., the closure of DSR 576, a diversion of the Clintonville Main to the Broad Meadows Relief Sewer, a sanitary-to-sanitary relief connection between the Clintonville Main and the Adena Brook Relief Sewer, and the rehabilitation of 57 manholes in accordance with the plans (CC-14497) and specifications.  The Director of Public Utilities publicly opened three competitive bid proposals on August 1, 2007.  The cumulative results of these bids were: Kokosing Construction Company, Inc. submitted a bid of $2,945,485.58; Insituform Inc. submitted a bid of $2,948,267.20; and Reynolds Inliner submitted a bid of $3,476,826.00.  The Engineer's Estimate for this project was $3,404,748.00.  
 
CONTRACT COMPLIANCE NO.: 31-1023518, expires 3/16/08, Majority.
 
FISCAL IMPACT:  This ordinance authorizes the transfer and appropriation of funds from the Sewer System Reserve Fund to the OWDA Loan Fund in order to fund this proposed expenditure.  This transaction is a temporary measure that is required until such time as the Department is able to execute a loan agreement with the Ohio Water Development Authority and reimburse the Sewer System Reserve Fund.
 
3.  EMERGENCY DESIGNATION:  The Division of Sewerage and Drainage is requesting City Council to consider this legislation an emergency measure in order to allow for the immediate execution of the subject contract.   This project is one of several projects the City is undertaking to fulfill commitments contained within the Consent Order executed between the City of Columbus and the Ohio Attorney Generals Office.  In order to ensure that the City meets the scheduling constraints of this project, it is imperative that a notice-to-proceed be issued as soon as possible.

Body
WHEREAS, three competitive bids for the construction of the Clintonville Main Rehabilitation Project, were received on August 1, 2007; and
 
WHEREAS, it is immediately necessary for the City Council to both appropriate funds from the Sewer System Reserve Fund and authorize the transfer of said funds into the Ohio Water Development Authority Loan Fund; in order to temporarily fund this expenditure, until such time as the City is able to execute a loan for the above stated purpose and reimburse the Sewer System Reserve Fund; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, in that it is necessary for this City Council to authorize the Director of Public Utilities to execute a contract for the construction of the Clintonville Main Rehabilitation Project; to appropriate and authorize the expenditure of the proceeds from the aforementioned loan, all of which is necessary to allow for the immediate rehabilitation of this aging and structurally deficient sanitary sewer infrastructure, for the preservation of the public health, peace, property, and safety; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That from the unappropriated monies in the Sewer System Reserve Fund 654, and from all monies estimated to come into said fund from any and all sources, and unappropriated from any other purpose for the Clintonville Main Rehabilitation Project, the sum of $2,945,485.58 is hereby appropriated to the Division of Sewerage and Drainage, Division 60-05 | Object Level One 10 | Object Level Three 5502 | OCA Code 901654.
 
Section 2.  That the City Auditor is hereby authorized to transfer $2,945,485.58 to the OWDA Loan Fund No. 666, into the appropriate project accounts as specified below, at such time as deemed necessary by him, and to expend said funds, or so much thereof as may be necessary.
 
Section 3.  That the $2,945,485.58 is hereby appropriated for the Clintonville Main Rehabilitation Project within the OWDA Loan Fund No. 666 | Division 60-05 | as follows:

Section 4.  That upon obtaining other funds for the purpose of funding sanitary sewer system capital improvement work, the City Auditor is hereby authorized to repay the Sewer System Reserve Fund the amount transferred above, and said funds are hereby deemed appropriated for such purposes.
 
Section 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for any contract or contract modifications associated with the expenditure of the funds transferred herein above.
 
Section 6.  That the Director of Public Utilities be, and hereby is, authorized to award and execute a contract for the construction of the Clintonville Main Rehabilitation Project with the lowest, and best bidder, Kokosing Construction Company, Inc.,  886 McKinley Avenue, Columbus, OH 43222, in the amount of $2,945,485.58, in accordance with the terms and conditions of the Contract on file in the Sewer System Engineering Section Office of the Division of Sewerage and Drainage.
 
Section 7.  That the expenditure of $2,945,485.58, or as much thereof as may be needed, is hereby authorized from the OWDA Loan Fund No. 666 | Division 60-05 | as follows:

Section 8.  That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project by monies from more than one source.
 
Section 9. That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
Section 10. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
Section 11.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
