Explanation
Background: This legislation authorizes the Public Service Director to modify and increase the Transportation Division's engineering services contract with M-E Companies for the Henderson Road Improvement Project. The contract modification is necessary as the Division of Power and Water (Water) requested the design of an 8" water line from High Street to the Olentangy River along Henderson Road. Since the Transportation Division's original contract involves tearing up the road, it is logical to replace aging water lines now rather than tearing up the same road in the future. This saves not only time and cost, but an inconvenience to roadway traffic.

2. Reasons additional goods/services could not be foreseen:
The need for additional services was foreseen. The project has been on-going since 2000, but it was not known what year funds would be needed.
3. Reason other procurement processes are not used:
This project is a continuation of the existing work being performed and it would not be practical to contract with a different consultant. There are significant time and cost savings by having the same company perform the work.
4. How cost of modification was determined:
New hourly rates, overhead rate, and percentage of profit were provided by M-E Companies via letter dated April 11, 2007. These rates were negotiated between M-E and the City.
M-E Companies (C.C.# 31-1442777, expires 2/18/08, majority) was selected in accordance with Chapter 329 for professional service contracts.
It is requested that this Ordinance be handled in an emergency manner in order that the modification of the design contract be completed and reviewed within the next four months in order to maintain the anticipated autumn bid date.
Fiscal Impact: Funding will be provided by the Department of Public Utilities, Division of Power and Water (Water). Additionally, this legislation includes a transfer of funds within the Water Works Enlargement Voted 1991 Bonds Fund and an amendment to the 2007 Capital Improvements Budget.

To authorize the Public Service Director to modify and increase the existing engineering services contract with M-E Companies for the design of an 8" water line from High Street to the Olentangy River along Henderson Road; to authorize the transfer of funds and the expenditure of $43,204.53 from the Water Works Enlargement Voted 1991 Bonds Fund; to authorize an amendment to the 2007 Capital Improvements Budget; and to declare an emergency. WHEREAS, Contract No. EA012860-002 was authorized by Ordinance 0491-2000, passed March 6, 2000 and executed and approved by the City Attorney on March 22, 2000; and
WHEREAS, it is necessary to modify and increase this contract in order to design an 8" water line from High Street to the Olentangy River along Henderson Road, as requested by the Division of Power and Water (Water); and
WHEREAS, it is necessary for this Council to authorize the City Auditor to transfer funds within the Water Works Enlargement Voted 1991 Bonds Fund; and
WHEREAS, it is necessary to authorize an amendment to the 2007 Capital Improvements Budget for purposes of providing sufficient funding and spending authority for the aforementioned project expenditures; and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division; in that it is immediately necessary to authorize the Public Service Director to modify and increase the existing engineering services contract with M-E Companies; to design an 8" water line from High Street to the Olentangy River along Henderson Road; for the Henderson Road Improvement Project; in an emergency manner in order that the modification of the design contract be completed and reviewed within the next four months in order to maintain the anticipated autumn construction bid date; for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Public Service Director be and is hereby authorized to modify and increase Contract No. EA012860-002; with M-E Companies, 635 Brookside Boulevard, Westerville, Ohio 43081; to design an 8" water line from High Street to the Olentangy River along Henderson Road; for the Henderson Road Improvement Project; in accordance with the plans on file in the office of the Public Service Director.
SECTION 2. That this contract modification is in compliance with Section 329.16 of Columbus City Codes, 1959.
SECTION 3. That the City Auditor is hereby authorized to transfer $39,126.95 within the Division of Power and Water (Water), Dept/Div. No. 60-09, Water Works Enlargement Voted 1991 Bonds Fund, Fund No. 606, Object Level One 06, Object Level Three 6682, as follows:

SECTION 5. That for the purpose of paying the cost thereof, the sum of $43,204.53 or so much thereof as may be needed be and hereby is authorized to be expended from the Department of Public Utilities, Division of Power and Water (Water), Dept/Div. No. 60-09, Water Works Enlargement Voted 1991 Bonds Fund, Fund No. 606, Object Level One Code 06, Object Level Three Code 6682, OCA Code 642900, Project No. 690236.
SECTION 6. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
SECTION 7. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
