Explanation

 

BACKGROUND: This ordinance authorizes the Director of Finance and Management to purchase OpenLab software and hardware for the six existing Agilent gas chromatograph mass spectrometers (GC/MS) used to confirm controlled substances in submitted evidence using grant funds in the amount of $95,780.56. OpenLab offers numerous and significant features that are not possible with the software currently in use by the Drug Identification Section.  OpenLab allows analysts the ability to upload data in an electronic format from the instrument to the laboratory information management system, operate each GC/MS instrument remotely, and review data simultaneously for multiple users while the instrument is operating.  This creates a paperless workflow, which will improve the effectiveness of section operations and reduces case turnaround time.  OpenLab software and hardware is the only package compatible with all the various models of GC/MS instrumentation currently used at the Columbus Police Crime Laboratory.  It is proprietary to and only available from the manufacturer, Agilent Technologies.  The Division of Police needs to transfer appropriated money within the Grant Project G332100.   The funds will be transferred from 02 Supplies and Materials to 03 Contractual Services in the amount of $49,728.46 and 06 Equipment in the amount of $18,167.25.

 

 

BID INFORMATION:  Agilent Technologies is the sole manufacturer of OpenLab. Agilent Technologies is the only company able to provide on-site installation, implementation, and key user training of their product; therefore this contract is being awarded pursuant to the sole source provisions of Chapter 329 of City Code.

 

This company is not debarred according to the Federal excluded parties listing or prohibited from being awarded a contract according to the Auditor of State unresolved findings for recovery certified search.

EMERGENCY DESIGNATION: Emergency legislation is requested to save money prior to the new year’s price increases as the quote is only good through the end of January 2022, and to supply the crime lab with the necessary tools to further improve efficiency and operations of the Drug Identification Section.

 

FISCAL IMPACT:   The purchase of the OpenLab software and hardware package from Agilent Technologies in the amount of $95,780.56 will be made using grant funds from the JAG grant. This ordinance authorizes a transfer of $67,895.71 within G332100 from 02 to 03 and 06.

Body

 

WHEREAS, the Division of Police Crime Lab, Department of Public Safety needs to purchase the OpenLab software and hardware package; and

 

WHEREAS, Agilent Technologies, Inc. is a sole source provider of the OpenLab software and hardware and is the only company that can install, train users and implement said system; and

 

WHEREAS, this contract is being awarded pursuant to the provisions of Chapter 329 of City Code relating to sole source procurement; and

 

WHEREAS, funds are budgeted through the JAG Grant and will be used for the purchase of the OpenLab software and hardware package; and

 

WHEREAS, it is in the best interest of the City to enter said agreement in accordance with the relevant sole source provisions of the City of Columbus Code ; and

 

WHEREAS, the Division needs to transfer $67,895.71 within G332100 from 02 to 03 an 06; and

 

WHEREAS,  an emergency exists in the usual daily operation in the Division of Police, Department of Public Safety, in that it is immediately necessary to purchase the OpenLab software and hardware package as soon as possible for the preservation of the public health, peace, property, safety, and welfare; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Director of Finance and Management be and is hereby authorized and directed to enter into a contract for with Agilent Technologies Inc. for the purchase of  the OpenLab software and hardware package for the Division of Police Crime Lab, Department of Public Safety.

 

SECTION 2. That the expenditure of $95,780.56 or so much thereof as may be needed, is hereby authorized from the Division of Police's JAG Grant funds, per the accounting codes in the attachment to this ordinance:

 

SECTION 3. That said contract shall be awarded in accordance with the sole source provisions of Chapter 329 of the Columbus City Code.

 

SECTION 4. That the sum of $67,895.71 be an hereby is authorized to be transferred within the appropriated funds of G332100 per the account codes in the attachment to this ordinance.

 

SECTION 5. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance and to make any accounting changes necessary to ensure that this contract is properly accounted for and recorded accurately on the City's financial records.

 

SECTION 6.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 7. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
