Title: To authorize the Public Service Director to execute those documents required to grant an encroachment easement into Marconi Boulevard for a new entrance canopy for the One Marconi Place project at 274 Marconi Boulevard.
Explanation
 
The Public Service Department, Transportation Division, recently received a request from Arena One, Inc., asking that the City grant an encroachment easement into Marconi Boulevard, south of Nationwide Boulevard.  The granting of the requested encroachment easement will allow for construction of a new entrance canopy for the One Marconi Place project at 274 Marconi Boulevard.  After investigation it has been determined that the granting of the requested encroachment easement will not adversely affect the City's continued use of the Marconi Boulevard right-of-way and that the requested encroachment easement should be granted.  A value of $1,500.00 has been established for the granting of this easement.
 
The City will receive a total of $1,500.00, to be deposited in Fund 748, Project 537650, as consideration for the granting of the requested easement.

WHEREAS, the City of Columbus, Public Service Department, Transportation Division, recently received a request from Arena One, Inc., asking that the City grant an encroachment easement into Marconi Boulevard, south of Nationwide Boulevard; and
 
WHEREAS, the granting of the requested encroachment easement will allow for construction of a new entrance canopy for the One Marconi Place project at 274 Marconi Boulevard; and
 
WHEREAS, after investigation it has been determined that the granting of the requested encroachment easement will not adversely affect the City's continued use of the Marconi Boulevard right-of-way; and
 
WHEREAS, a value of $1,500.00 has been established for the granting of the requested encroachment easement; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Public Service Director be and is hereby authorized to execute those documents necessary to grant the following described encroachment easement to Arena One, Inc.; to-wit:
 
Being an Encroachment Easement in Marconi Street south of Locust Street in the City of Columbus, in the County of Franklin and in the State of Ohio and being more particularly described as follows:
Beginning, for reference, at the southwesterly corner of Inlot Number 38 of the City of Columbus plat;
Thence northerly 57.5 feet, in the westerly line of Inlot 38 and in the easterly line of Marconi Street (82.5 feet wide), to the Place of Beginning;
Thence westerly 10.0 feet, at right angles to the easterly line of Marconi Street, to a point;
Thence northerly 15.0 feet, parallel to and 10.0 feet westerly of said easterly line of Marconi Street, to a point;
Thence easterly 10.0 feet, at right angles to the easterly line of Marconi Street, to the easterly line of Marconi Street;
Thence southerly 15.0 feet, in the easterly line of Marconi Street and the westerly line of Inlots 37 and 38, to the place of beginning and extending from elevation 730.0 to elevation 749.0 (NAVD88), containing 2850 cubic feet more or less.
This description is based on One Marconi Place architectural plans, Project Number 01050 dated 4/10/03, sheet 5 0f 8 of a proposed structure by Stacy & Asebrook, Ltd., Columbus, Ohio and on the results of a field survey in August, 2003 by Gary Elswick, Registered Surveyor #6395.
 
Section 2.  That the $1,500.00 to be received by the City as consideration for the granting of the requested encroachment easement shall be deposited in Fund 748, Project 537650.
 
Section 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
