Explanation
1.  BACKGROUND:  This legislation authorizes the City Auditor to transfer, and appropriate $939,236.39 from the Storm Sewer System Reserve Fund to the Storm Sewer Bond Fund in connection with the Department of Transportation's Rarig, 6th Avenue and 7th Avenue Project, which is being authorized within Ordinance No. 0587-2004.  This project is a cooperative effort between the Public Service and Public Utilities Departments that includes the coordination of all planned capital improvements into one combined construction contract for purposes of reducing overall construction costs and to minimize the disruption that separate project would have caused to the surrounding community.
 
2.  FISCAL IMPACT:  This fund transfer from the Storm Sewer System Reserve Fund to the Storm Sewer Bond Fund is a temporary measure, until such time as the proceeds from a bond sale can be made available.  There is sufficient budget authority within the 2003 Capital Improvements Budget for this expenditure.
 
3.  EMERGENCY LEGISLATION:  The Division of Sewerage and Drainage is requesting City Council to consider this legislation an emergency measure in order to provide the funds required to allow for the award of the subject construction contract pursuant to the completion of the improvements by the summer of 2005.

To authorize the City Auditor to transfer, and appropriate $939,236.39 from the Storm Sewer System Reserve Fund to the Storm Sewer Bond Fund, in connection with the Rarig Avenue, 6th and 7th Avenues Project, for the Division of Sewerage and Drainage, and to declare an emergency. ($939,236.39)
 
Body
WHEREAS, the Department of Public Service and the Department of Public Utilities have determined it to be in the City's best interest to coordinate the installation of roadway and stormwater infrastructure improvements by combining them into one construction project, known as the Rarig, 6th Avenue and 7th Avenue Project, for purposes of reducing overall project expenses and to minimize the impact that construction activities would have on the surrounding community; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, in that it is immediately necessary to authorize the City Auditor to transfer funds from the Storm Sewer System Reserve Fund to the Storm Sewer Bond Fund; for purposes of providing the funding for the specific costs attributed to the stormwater improvements that are included within the construction contract award that is being authorized under separate companion legislation and in order to provide the funds required to allow for the award of the subject construction contract pursuant to the completion of the improvements by the summer of 2005, all for the preservation of the public health, peace, property and safety, now therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That from the unappropriated monies in the Storm Sewer System Reserve Fund, and from all monies estimated to come into said fund from any and all sources, and unappropriated for any other purpose during the fiscal year ending December 31, 2004, the sum of $939,236.39, is hereby appropriated to the Division of Sewerage and Drainage, Division 60-15| Object Level 10| Object Level Three 5502| OCA Code 901685.
 
Section 2.  That the City Auditor is hereby authorized and directed to transfer $939,236.39, from the Storm Sewer System Reserve Fund to the Storm Sewer Bond Fund No. 685| 6th, 7th, Rarig Avenue Project| Project No. 610542| OCA Code 685542| Object Level Three No. 6621.
 
Section 3.  That upon obtaining other funds for the purpose of funding the aforementioned stormwater system improvements project work, the City Auditor is hereby authorized to repay the Storm Sewer System Reserve Fund the amount transferred under Section 2., above, and said funds are hereby deemed appropriated for such purpose.
 
Section 4.  That the City Auditor is authorized to make any accounting changes to revise the funding source for any contract associate the expenditure of the funds transferred under Section 2., above.
 
Section 5.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
