Explanation
1.  BACKGROUND:
This legislation authorizes the Director of Public Utilities to enter into a professional engineering services contract with the Ribway Engineering Group, Inc.  This contract will provide for the preparation of construction plans and specifications for the Chestnut and Sixth Street Combined Sewer Rehabilitation Project.  This project will rehabilitate the remaining portions of the Central Relief Sewer in the downtown area of Columbus, that was constructed in 1906, and will include the installation of a connecting 72-inch diameter storm sewer within Naghten Street, turn northward at Cleveland Avenue and terminate at the intersection of Cleveland Ave. and Mt. Vernon Ave.  The installation of this storm sewer will allow for the removal of storm flows from the Central Relief Sewer thereby improving the sanitary capacity within this system.
 
2.  PROCUREMENT INFORMATION:
The basis for selection of the chosen professional engineering services firm: The Division advertised Request for Statement of Qualifications (RFSQ's) for the subject services in the City Bulletin in accordance with the provisions of Section 329.13 of Columbus City Codes.  Three firms were short-listed and were requested to submit technical proposals for this project.  These proposals were reviewed and ranked by a Professional Engineering Services Selection Committee in order to determine the consultant best qualified to provide the services for this project.  The Division of Sewerage and Drainage received technical proposals on January 23, 2004 from the Ribway Engineering Group; Burgess & Niple;and  E.M.H&T.  The committee ranked the proposals on quality and feasibility.  After careful consideration, the committee recommended that the Ribway Engineering Group, Inc.  be selected to provide the engineering services for these projects, for which the Director of Public Utilities has concurred.
 
3.  FISCAL IMPACT:
This ordinance requests the appropriation and transfer of funds from the Sewerage System Reserve Fund to the Ohio Water Pollution Control Loan Fund in order to fund this proposed expenditure.  This transaction is a temporary measure that is required until such time as a loan from the Ohio Water Development Authority is in place, and the Division of Sewerage of Drainage requests reimbursement for said expenditures.
 
4.  EMERGENCY DESIGNATION:
The Division of Sewerage and Drainage is requesting City Council to designate this ordinance an emergency measure in order to allow for the immediate commencement of this work.  This project will rehabilitate infrastructure that is almost 100 years old within the downtown area of Columbus, and will ensure the continued operation of this vital infrastructure.

Body
WHEREAS, the Division of Sewerage and Drainage has undertaken a comprehensive review of downtown sanitary and combined infrastructure and has identified the need to rehabilitate specific sections of the Central Relief Sewer, which shall be known as the Chestnut and Sixth Street Combined Sewer Rehabilitation Project; and  
            
WHEREAS, the Director of the Public Utilities requested detailed proposals from the firms of Ribway Engineering Group, Inc.; Burgess & Niple; and Evans, Mechwart, Hambleton & Tilton; for the aforementioned project services, and received these proposals on January 23, 2004, in accordance with the procurement provisions of Section 329.13 of the Columbus City Codes; and
 
WHEREAS, based upon an evaluation of these proposals utilizing predetermined criteria, a selection committee determined that Ribway Engineering Group, Inc. , submitted the best proposal for the required project services, to which the Director of the Department of Public Utilities concurred; and
 
WHEREAS, it is immediately necessary to both appropriate funds from the Sewer System Reserve Fund and to transfer said funds into the Ohio Water Pollution Control Loan Fund; in order to temporarily fund this expenditure, until such time as the City sells notes or bonds for the above stated purpose and reimburse the Sewage System Reserve Fund;
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, in that is has been determined necessary for this Council to authorize the Director of Public Utilities to award a professional engineering services contract for purposes of providing the aforementioned services; to authorize the appropriation and transfer of funds from the Sanitary Sewer Reserve Fund to the Water Pollution Control Loan Fund; and to amend the 2004 Capital Improvements Budget, pursuant to the rehabilitation of the Central Relief Sewer within the downtown area of Columbus for purposes of ensuring  continued operation of this vital infrastructure, for the immediate preservation of the public, health, peace, and safety, now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That from the unappropriated monies in the Sewerage System Reserve Fund 654, and from all monies estimated to come into said fund from any and all sources, and unappropriated for any other purpose during the fiscal year ending December 31, 2004, the sum of $578,813.00 is hereby appropriated to the Division of Sewerage and Drainage, Division 60-05, Object Level One 10, Object Level Three 5502, OCA Code 901654.
 
Section 2.  That the City Auditor is hereby authorized and directed to transfer $578,813.00 to the Ohio Water Pollution Control Loan Fund No. 666, into the appropriate project accounts as specified within Section 3 herein, at such time as deemed necessary by him, and to expend said funds, or so much thereof as may be necessary.
 
Section 3.  That the sum of $578,813.00 is hereby appropriated for the following sanitary sewer system projects within Ohio Water Pollution Control Loan Fund No. 666| Division 60-05| Object Level Three No. 6676| as follows:

Section 4.  That upon obtaining other funds for the purpose of funding sanitary sewer system capital improvement work, the City Auditor is hereby authorized to repay the Sewerage System Reserve Fund the amount transferred under Section 2., above, and said funds are hereby deemed appropriated for such purpose.
 
Section 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for any contract or contract modifications associated with the expenditure of the funds transferred under Section 2., above.
 
Section 6.  That the Director of Public Utilities be, and hereby is, authorized to enter into a professional engineering services contract with the Ribway Engineering Group, Inc., 350 East Broad Street, Suite 500, Columbus, Ohio 43215, in connection with the Chestnut and Sixth Street Combined Sewer Rehabilitation Project, in accordance with the terms and conditions of the Contract on file in the office of the Division of Sewerage and Drainage's Sewer System Engineering Section.
 
Section 7. That the expenditure of $578,813.00, or as much thereof as may be needed, be and the same hereby is authorized from the Ohio Water Pollution Control Loan Fund No. 666; Division 60-05; within the following project:

Section 8.  That the 2004 Capital Improvements Budget Ordinance No. 1059-2004 is hereby amended as follows, in order to provide sufficient budget authority for the execution of the subject professional engineering services contract:

Section 9.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
