Explanation

BACKGROUND:

This ordinance amends the current authorized strength, as set forth in ordinance 0160-2007 as follows:

 

The general fund part-time strength of the Municipal Court Clerk is increased by 5 to give the Court increased flexibility in staffing, especially during the evening and nighttime hours.  These positions will be used in lieu of full-time positions, though the full-time strength will remain the same.

 

The general fund full-time strength of the Facilities Management Division is increased by 2 to accommodate an increase in security personnel as recommended in the City Hall security audit.

 

The general fund part-time strength of the Human Resources Department is increased by 1 to provide additional administrative support to the department for labor negotiations.

 

The Health Department's grants full-time and part-time strengths are increased by 11 and 7 respectively to accommodate increased funding of the Public Health Infrastructure, Tuberculosis Prevention and Control, and Women, Infants and Childrens Grants.

 

The grants full-time strength of Building Development Services (BDS) is decreased by 14 to correct an error inadvertently included in the previous ordinance (BDS has no grant funded employees).

 

To consolidate management of the city's assets, ordinance 0336-2007 was passed.  This ordinance authorized transfer of the Fleet Management Division to the Department of Finance and Management as well as other internal realignments.  Changes in authorized strength are needed to be consistent with changes set forth in this ordinance, which include:

                     the transfer of Purchasing (including the Print Shop) from the Director's Office to the Division of Financial Management, requiring the following -

o                     a decrease to the Finance and Management Director's Office general fund full-time strength by 16;

o  a decrease to Finance and Management Director's Office other fund full-time strength by 2;

o  an increase to Financial Management Division's general fund full-time strength by 16; and

o  an increase to the Financial Management Division's other fund full-time strength by 2.

 

                     the transfer of the Fleet Management Division to the Finance and Management Department, requiring the following-

o                     a decrease to the Fleet Management Division's other fund full-time strength by 123, and an elimination of the reference to it under the Public Service Department;

o  a decrease to the Public Service Director's Office's other fund full-time strength by 7;

o  the creation of a reference to the Fleet Management Division under the Department of Finance and Management and the subsequent setting of it's other fund full-time authorized strength at 124 (123 positions from original Fleet Division and one from the Department of Technology with no commensurate reduction).

o  an increase in the other fund full-time strength of the Finance and Management Director's Office of 8.

 

Companion legislation has been submitted which authorizes the transfer of Fleet funds to the Department of Finance and Management and the transfer of appropriation from the Finance and Management Director's Office to Financial Management Division for Purchasing and the Print Shop.  Authorized strength changes associated with passage of ordinance 0336-2007 should be effective starting at 12:01 a.m., May 1, 2007, but not before.

 

FISCAL IMPACT:

The only change herein associated with increased costs is that of the Health Department Grants.  The Department recently received increased levels of funding from these grants to accommodate the changes.  Other changes requested in this ordinance will have negligible or no costs associated with them or can be absorbed within amounts currently budgeted. The additional position being picked-up by the Finance and Management Director's Office is being done so with transferred authority previously used in the Public Service Director's Office for split-funded positions.  The positions, once transferred to Finance and Management, will be 100 percent funded by Fleet Operating Fund revenues.

 

EMERGENCY ACTION:

Emergency action is needed to ensure that this ordinance is effective simultaneous or prior to passage of that which transfers funding.

 

 

Title

To establish a new authorized strength ordinance for the various city divisions; to repeal ordinance 0160-2007, and to declare an emergency. (REPEALED BY ORD. 1241-2007 PASSED 7/23/2007)

 

 

Body

WHEREAS, it is necessary to increase the general fund part-time strength of the Municipal Court Clerk by five for staffing flexibility; and

 

WHEREAS, it is necessary to increase the general fund full-time strength of the Facilities Management Division by two to provide for an increase in security staff as recommended in the City Hall security audit; and

 

WHEREAS, it is necessary to increase the grant fund full-time and part-time strengths of the Health Department by 11 and 7, respectively,  to allow for expansion in three grant programs; and

 

WHEREAS, it is necessary to decrease the other fund full-time strength of Building Development Services by 14 to correct a typographical error in the previous authorized strength ordinance; and

 

WHEREAS,  to accurately reflect the realignment of the city's asset management program pursuant to ordinance 0336-2007, it is necessary to transfer 18 full-time positions from the Director's Office to the Division of Financial Management, comprised of 16 general fund and 2 other fund positions in the Purchasing Office; transfer 100 percent of the strength, totaling 123 positions, of the Division of Fleet Management, from the Department of Public Service to the Department of Finance and Management and subsequently increase that figure by 1 to accommodate a transfer from the Department of Technolgoy, for a total other fund full-time strength of 124; transfer 7 other fund full-time positions from the Public Service Director's Office to the Finance and Management Director's Office and subsequently increase that figure by 1 for a total other fund full-time strength of 8; and

 

WHEREAS, changes related to the aforementioned realignment shall not be effective until 12:01 a.m., May 1, 2007; and

 

WHEREAS, an emergency exists in the usual daily operation of the City of Columbus in that it is immediately necessary to establish a new authorized strength ordinance, to properly align the authorized strength for departments and divisions to reflect various needs within the city, to provide for the efficient operation of the city, and for the immediate preservation of the public health, peace, property, safety and welfare; Now, Therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS

 

 

SECTION 1.  That pursuant to Section 14, of the City Charter, the maximum number of officers and employees authorized to be employed within the various Departments, Boards and Offices of the City and hereby fixed and established as follows:

The foregoing positions authorized include all positions within each department, division, board, office or commission, whether appointed or elected except the members of any board or commission authorized by charter or ordinance.

 

No Appointing Authority shall appoint full-time or part-time personnel in excess of the maximum permitted by this ordinance unless authorized by ordinance of City Council.

 

SECTION 2.  Such of the positions within the Division of Fire as the Director of Public Safety and Fire Chief shall designate, shall be within the uniformed ranks and all other positions therein shall be deemed civilian positions, provided there shall not be in excess of five (5) Fire Assistant Chiefs and there shall not be in excess of four (4) Fire Deputy Chiefs; as a normal complement in excess of thirty-four (34) Fire Battalion Chiefs nor as a temporary complement in excess of thirty-five (35) Fire Battalion Chiefs at any one time; fifty-six (56) Fire Captains nor as a temporary complement in excess of fifty-nine (59) Fire Captains at any one time; one (1) Fire Chief; and one-hundred ninety six (196) Fire Lieutenants.  The complements of fire captains and fire lieutenants are intended to be temporary, subject to review and change at any time.

 

Such of the positions within the Division of Police as the Director of Public Safety and the Police Chief shall designate, shall be within the uniformed ranks and all other positions therein shall be deemed civilian positions, provided there shall not be, as a normal complement, in excess of eighteen (18) Police Commanders nor as a temporary complement in excess of nineteen (19) Police Commanders at any one time; one (1) Police Chief; in excess of, as a normal complement five (5) Police Deputy Chiefs nor as a temporary complement in excess of six (6) Police Deputy Chiefs at any one time; in excess of, as a normal complement, fifty-five (55)  Police Lieutenants nor as a temporary complement; in excess of fifty-seven (57) Police Lieutenants at any one time; in excess of, as a  normal complement; two hundred twenty-five (225) Police Sergeants nor as a temporary complement in excess of two hundred twenty-nine (229) Police Sergeants at any one time.

 

SECTION 3.  Temporary appointments are not subject to the authorized strength ordinance.  Additionally, limited appointments made to cover full-time and part-time employees on authorized leave (injury, disability or military leave) are not subject to the authorized strength ordinance.

 

SECTION 4.  That Ordinance No. 0160-2007 and all other ordinances relative to the authorization of employees for any department, division, board or commission and all other ordinances in conflict herewith be and the same are hereby repealed.

 

SECTION 5.  That the effective date of the authorized strength changes related to the realignment of management of citywide assets and the reorganization of the Department of Finance and Management as outlined herein, is 12:01 a.m., May 1, 2007

 

SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
