BACKGROUND:  The Columbus Health Department, on behalf of the State Homeland Security Program, was awarded a grant from the Franklin County Office of Homeland Security and Justice for the acquisition of pharmaceuticals to strengthen current Columbus Metropolitan Medical Response System stocks of pharmaceuticals for emergency responders and add local capability for treating exposure to biological agents, nerve agents, and radiation until the strategic national stockpile arrives from the CDC in the event of  bioterrorism activity in central Ohio.  The Intergovernmental Agreements permit the City of Columbus and Franklin County to make these federal sub-grant expenditures and these agreements per Ordinance 1691-2006 passed 10/18/06.  This ordinance authorizes the acceptance of the $300,000 grant from the Franklin County Office of Homeland Security and Justice and the purchase of pharmaceuticals from Akorn, Inc,; Heyltex Corp.; Meridian Medical Technologies; and Capital Wholesale in the amount of $260,588.92 for the period ending December 31, 2008.
Bid Information: Negotiated pricing was received from Akorn, Inc, Heyltex and Meridian Medical Technologies. Akorn, Inc. and Heyltex are sole manufacturers for the pharmaceuticals required to treat radiation exposure.  Meridian is the sole manufacturer for pharmaceuticals required to treat convulsions due to nerve agent treatments. Due to the deadline of this grant, December 31, 2008, these purchases must be expedited and the City of Columbus, the Columbus Health Department is requesting that the pharmaceuticals be purchased from the sole source providers of the bioterrorism pharmaceuticals, Akorn, Inc.; Heyltex and Meridian Medical Technologies as follows:

SA002933 was publicized through Vendor Services on the City web site seeking bids for pharmaceuticals to augment the existing bioterrorism caches with prophylactic antibiotics and anti-convulsive treatments in the event of bioterrorism activity in central Ohio.  The City of Columbus received two responses and Capital Wholesale was selected as being the best and most responsive bid.  The Columbus Health Department is requesting pharmaceuticals be purchased from Capital Wholesale as follows:

These companies are not debarred according to the Federal excluded parties listing or prohibited from being awarded a contract according to the Auditor of State unresolved findings for recovery certified search.
Emergency Designation: Emergency legislation is requested to expedite the process of the award from the Franklin County Office of Homeland Security and Justice.

FISCAL IMPACT:  There is no fiscal impact for the Health Special Revenue Fund, Health Department Grants Fund or the City of Columbus.  The Intergovernmental Agreement permits City of Columbus and Franklin County to make the federal sub-grant expenditures.  Franklin County will create all purchase orders and pay all bills.

To authorize the Finance and Management Director to execute those documents necessary for the acquisition of pharmaceuticals from Akorn, Inc., Heyltex Corp, Meridian Medical Technologies and Capital Wholesale utilizing the Homeland Security Grant, in accordance with sole source procurement and competitive sealed bidding City Code provisions, and to declare an emergency.

WHEREAS,  the Columbus Health Department was awarded a grant from Franklin County Office of Homeland Security and Justice; and
WHEREAS, these pharmaceuticals will be used for the treatment of radiation exposure, the treatment of convulsions related to nerve agents, and for the prevention of the effects of exposure to biological agents, in the event of bioterrorism activity in central Ohio; and
WHEREAS, it is in the best interest of the City to enter into these purchasing agreements in accordance with provisions of Section 329.06 of the Columbus City Codes, 1959; and
WHEREAS, it is in the best interest of the City to enter into this purchasing agreement in accordance with provisions of Section 329.07c (Sole Source) of the Columbus City Codes, 1959; and
WHEREAS,  the Columbus Health Department is requesting the Finance and Management Director to execute the necessary documents for acquisition of these pharmaceuticals utilizing the Homeland Security Grant; and
WHEREAS, an emergency exists in the usual daily operation of the Columbus Health Department in that it is immediately necessary to execute the needed documents for the acquisition of  pharmaceuticals  from the federal sub-grant thereby preserving the public peace, property, health, safety and welfare; now therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That the Director of Finance and Management be and is hereby authorized and directed to execute those documents necessary for acquisition of  pharmaceuticals utilizing the Homeland Security Grant.
 
SECTION 2.  That the provisions for sole source procurement and competitive sealed bidding City Code provisions are hereby met.
SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
