Title: To authorize the Director of the Department of Public Utilities and the Director the Recreation and Parks Department, severally, to execute a Quitclaim Deed of Easement and any ancillary documents necessary to grant a perpetual utility easement to Columbia Gas Of Ohio, Inc. for the purpose of providing natural gas service to that city-owned real property, commonly known as the boathouse at Griggs Reservoir, and to declare an emergency.

Explanation

 

Background:  In 2007, the City of Columbus ('City") entered into a lease agreement with The Ohio State University ("OSU" as authorized by Ordinance No. 0879-2007 approved on June 18, 2007.  The agreement provided for the construction and shared use of a boathouse at Griggs Reservoir by the City and OSU within the city-owned Duranceau Park (3100 Thoburn Road, Columbus, Ohio  43221).  The city is to utilize the boathouse to conduct outdoor education programs as well as outdoor training classes, which are to be made available to city employees as well as the general public.  It is now necessary that the city grant Columbia Gas Of Ohio, Inc., ("Columbus Gas"), an Ohio corporation, a perpetual non-exclusive easement unto that city property, more fully described within the body of this legislation, in order to provide natural gas utility service.  The Department of Public Utilities has determined that the utility service from Columbia Gas will benefit the city, and that it is in the best interest of the city to grant the easement at no charge.  The following legislation authorizes the Director of the Department of Public Utilities and the Director of the Department of Recreation and Parks to execute those instruments necessary to grant the requested easement.

 

Fiscal Impact:  N/A

 

Emergency Justification:  Emergency action is requested as not to delay the benefit to the city, which will result from the construction and installation of the natural gas service line.

To authorize the Director of the Department of Public Utilities and the Director the Recreation and Parks Department, severally, to execute a Quitclaim Deed of Easement and any ancillary documents necessary to grant a perpetual utility easement to Columbia Gas Of Ohio, Inc. for the purpose of providing natural gas service to that city-owned real property, commonly known as the boathouse at Griggs Reservoir, and to declare an emergency.

 

Body

 

WHEREAS,                      in 2007, the City of Columbus ('City") entered into a lease agreement with The Ohio State University ("OSU"), as authorized by Ordinance No. 0879-2007 approved on June 18, 2007, for the construction and shared use of a boathouse at Griggs Reservoir within the city-owned Duranceau Park (3100 Thoburn Road, Columbus, Ohio 43221); and

 

WHEREAS,                      the city is to utilize the boathouse to conduct outdoor education programs as well as outdoor training classes, which are to be made available to both the general public and city employees; and

 

WHEREAS,                      it is now necessary that the city grant Columbia Gas Of Ohio, Inc. ("Columbus Gas"), an Ohio corporation, a perpetual non-exclusive easement unto certain city property, more fully described in the body of this legislation, in order to provide natural gas utility service; and

 

WHEREAS,                      the Department of Public Utilities has determined that the utility service provided by Columbia Gas will benefit the city, and that it is in the best interest of the city to grant the easement at no charge; and

 

WHEREAS,                     an emergency exists in the usual daily operation of the city of Columbus in that it is immediately necessary to authorize the Director of the Department of Public Utilities and the Director of the Recreation and Parks Department, severally, to execute those instruments approved by the Real Estate Division, Department of Law, necessary to grant an utility easement to Columbia Gas Of Ohio, Inc. in order to provide natural gas service to that city-owned property commonly known as boathouse at Griggs Reservoir, thereby preserving the public health, peace, property, safety, and welfare; NOW, THEREFORE:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

                     Section 1.                     That the Director of the Department of Public Utilities, and the Director of the Recreation and Parks Department, severally, be and hereby is authorized to execute a Quit Claim Deed of Easement and any ancillary documents, as approved by the Real Estate Division, Department of Law, necessary to grant a perpetual non-exclusive easement to Columbia Gas Of Ohio, Inc., ("Columbus Gas"), an Ohio corporation, for the purpose of providing gas utility service to the following described city property:

 

 

Description of Gas Pipelines Easement

 

                     Situated in the State of Ohio, County of Franklin, City of Columbus, being located in that 24.55 acre tract as described in a deed to the City of Columbus of record in Deed Volume 914, Page 354, all records referenced herein being to those located in the Recorder's Office, Franklin County, Ohio, and being a gas pipelines easement more particularly described as follows:

                     Beginning at a point at the northeasterly terminus of Thoburn Road, at the southeasterly corner of Lot 6 of Dolph-Hil Acres Addition, a subdivision of record in Plat Book 24, Page 83, in the westerly line of said 24.55 acre tract;

                     Thence through said 24.55 acre tract the following 15 courses:

1.                     North 78° 49' 39" East, a distance of 205.56 feet to a point;

2.                     North 83° 08' 02" East, a distance of 87.08 feet to a point;

3.                     with a curve to the left, having a radius of 168.60 feet, a delta angle of 36°11' 08", a length of 106.48 feet, a chord bearing of North 65° 02' 28" East, a chord distance of 104.72 feet to a point;

4.                     with a curve to the right, having a radius of 358.12 feet, a delta angle of 43° 43' 37", a length of 273.31 feet, a chord bearing of North 72° 21' 26" East, a chord  distance of 266.72 feet to a point;

5.                     South 05° 34' 02" West, a distance of 192.87 feet to a point;

6.                     South 83° 58' 22" East, a distance of 7.57 feet to a point;

7.                     South 05° 35' 27" West, a distance of 51.52 feet to a point;

8.                     North 84° 24' 33" West, a distance of 10.00 feet to a point;

9.                     North 05° 35' 27" East, a distance of 41.60 feet to a point;

10.                     North 83° 58' 22" West, a distance of 7.57 feet to a point;

11.                     North 05° 34' 02" East, a distance of 192.40 feet to a point;

12.                     with a curve to the left, having a radius of 348.12 feet, a delta angle of 41° 59' 27", a length of 255.13 feet, a chord bearing of South 71° 32' 22" West, a chord  distance of 249.46 feet to a point;

13.                     with a curve to the right, having a radius of 178.60 feet, a delta angle of 36° 05' 03"  a length of 112.48 feet, a chord bearing of South 65° 05' 31"  West, a chord distance of 110.63 feet to a point;

14.                     South 83° 08' 02" West, a distance of 86.71 feet to a point;

15.                     South 78° 49' 39" West, a distance of 205.27 feet to a point in the westerly line of said 24.55 acre tract, in the easterly terminus line of said Thoburn Road;

                     Thence North 10° 38' 11" West, along said westerly line and said terminus line, a distance of 10.00 feet to the POINT OF BEGINNING, containing 0.210 acre of land.

                     The above described gas pipelines easement is also shown on "Exhibit B" attached hereto and made a part hereof. Bearings are based on North 10° 38' 11" West for the west line of said 24.55 acre tract. This description was prepared by Westerville Land Surveying, LLC based on available records.

                     Section 2.                     That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or 10 days after passage if the Mayor neither approves nor vetoes the same.
