Title: To authorize the City Attorney's Office, Real Estate Division to contract for professional services relative to the acquisition of fee simple title and lesser interests in and to property needed for the Bikeway Development - Hudson Street / Mock Road project, Bikeway Development - Olentangy to Alum Creek East - West Connector Phase 2 project and the Pedestrian Safety Improvement - Pedestrian Safety Improvements - Moler Road Sidewalks project; to authorize the City Attorney's Office, Real Estate Division to negotiate with property owners to acquire the additional rights-of-way necessary to complete these projects; to amend the 2012 C.I.B.; to authorize the transfer and expenditure of $510,000.00 within the Streets and Highways G.O. Bonds Fund for acquisition related expenses including professional service and land costs; and to declare an emergency.($510,000.00)
Explanation
1.  BACKGROUND
The City of Columbus, Department of Public Service, Division of Mobility Options, is engaged in the Bikeway Development - Hudson Street / Mock Road project, the Bikeway Development - Olentangy to Alum Creek East-West Connector Phase 2 Project and the Pedestrian Safety Improvements - Moler Road Sidewalks project.
 
The purpose of the Bikeway Development - Hudson Street / Mock Road project and the Bikeway Development - Olentangy to Alum Creek East-West Connector Phase 2 project is to construct bikeways that will connect the Olentangy Trail to the Alum Creek Trail.  The Hudson / Mock project will follow an alignment that includes these two streets as well as others that may be needed between the west end of Hudson Street and the Alum Creek Trail at the east end of Mock Road.  
 
The Olentangy to Alum Creek East -West Connector Phase 2 project will construct a combination on-street / shared-use path connection between the Northtowne Boulevard / Brittany Road intersection and the Alum Creek Trail spur at Wingfield Street. This facility will provide improved access for bicycles and pedestrians along the entire corridor.
 
The Pedestrian Safety Improvements - Moler Road Sidewalks project will construct 5 foot wide sidewalks on each side of Moler Road from Lockbourne Road to Progress Avenue.
Successful completion of these projects requires that the City acquire fee simple title and lesser interests in and to various properties along the project corridor as additional rights-of-way.  It is necessary to authorize the City Attorney's Office, Real Estate Division, to contract for professional services, to negotiate with property owners and to expend those funds necessary to acquire the additional rights-of-way needed to complete these projects.
2.  FISCAL IMPACT
Right-of-way acquisition costs for these three projects, including professional services, staff costs and land costs have been estimated to be $510,000.00.  These expenses are budgeted in the 2012 Capital Improvement Budget.  The bond sale for these budgeted items has not occurred yet necessitating the transfer of funds from projects with available cash.  After the bond sale occurs these projects will be reimbursed.
3.  EMERGENCY DESIGNATION
Emergency action is requested to allow the City Attorneys' Office, Real Estate Division to begin acquisition of the rights of way needed for this project immediately or as soon as needed.  Rights of way have been detailed on the design plans so that utilities can be relocated and construction of the improvements can proceed as currently scheduled.

WHEREAS, the City of Columbus, Department of Public Service, Division of Mobility Options, is engaged in the Bikeway Development - Hudson Street / Mock Road project, the Bikeway Development - Olentangy to Alum Creek East-West Connector Phase 2 Project, and the Pedestrian Safety Improvements - Moler Road Sidewalks project; and
WHEREAS, the purpose of the bikeway projects is to construct a bike facility along two corridors; between the west end of Hudson Street and the east end of Mock Road, between the Northtowne Blvd / Brittany Rd intersection and the Alum Creek Trail spur at Wingfield St; and
WHEREAS, these project include full depth installation of asphalt pavement and base, the installation of upgraded pedestrian / bicycle roadway crossings and ADA compliant ramps; and
WHEREAS, the Pedestrian Safety Improvements - Moler Road Sidewalks project will construct 5 foot wide sidewalks on each side of Moler Road from Lockbourne Road to Progress Avenue.
WHEREAS, successful completion of these projects require the City to acquire fee simple title and lesser interests in and to various properties located along the project corridors as additional rights-of-way; and
WHEREAS, right-of-way acquisition costs for these projects, including professional services, staff costs and land costs have been estimated to be a total of $510,000.00; and
WHEREAS, it is necessary to amend the 2012 C.I.B; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Mobility Options, in that it is necessary to authorize the City Attorney's Office, Real Estate Division, to contract for professional services, to negotiate with property owners to acquire the additional rights of way needed to complete these projects and to authorize the expenditure of the funds needed to pay for the right of way acquisition expenses associated with these projects for the preservation of the public health, peace, property, safety and welfare; now, therefore;
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That the City Attorney's Office, Real Estate Division, be, and hereby is, authorized to acquire fee simple title and lesser interests in and to certain parcels of real estate, to contract for professional services, and to negotiate with property owners to acquire the additional rights-of-way needed to complete the Bikeway Development - Hudson Street / Mock Road project, Bikeway Development - Olentangy to Alum Creek East-West Connector Phase 2 project, and the Pedestrian Safety Improvements - Moler Road Sidewalks project.
SECTION 2.  That the 2012 C.I.B. authorized by ordinance 0368-2012 be amended to provide sufficient authority for these projects as follows:

SECTION 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for any contract or contract modifications associated with this ordinance.
SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
