Explanation
BACKGROUND:
This ordinance will authorize the Director of Recreation and Parks to enter into contract with Franklin County Metro Parks in the amount of $300,000.00.
These funds will be used (along with Clean Ohio Revitalization Funds and Metro Parks funds) to remediate environmental conditions at the former City of Columbus Whittier Peninsula Impound Lot in 2011.  There are several locations at the site where chemicals of concern that were generated when the impound lot was active or predated the impound lot exceed acceptable standards.  These funds will be used to remove and properly dispose of impacted soils, or, they will be used to place a soil cap on the impacted soils allowing the site to be safely used for parks and recreation purposes.  These funds were identified in a Memorandum of Understanding between the City of Columbus and Metro Parks that was entered into in 2010.

Emergency Justification:
Emergency action is necessary.  This is a reimbursement agreement and the work is complete.
Fiscal Impact:
The expenditure of $300,000.00 is budgeted in the Recreation and Parks Voted Recreation and Parks Bond Fund.

 Body
               WHEREAS, it is necessary to enter into a contract with the Franklin County Metro Parks for the Whittier Peninsula Improvements; and
 
WHEREAS, funds are being moved to alternate project within Fund 702 to establish correct funding location for this project; and
                WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to enter into said contract for the preservation of public health, peace, property and safety; NOW, THEREFORE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.   That the Director of Recreation and Parks be and he is hereby authorized and directed to enter into contract with the Franklin County Metro Parks for the reimbursement of payments made for improvements to Whittier Peninsula.
 
SECTION 2. That the City Auditor is hereby authorized to transfer $300,000.00 within the voted Recreation and Parks Bond Fund No. 702 for the projects listed below:

To:
Dept 51-01: Project 510714-100000, OCA# 702714: Amount $300,000.00
 
SECTION 3.   That to pay the cost of said contract, the expenditure of $300,000.00 or so much thereof as may be necessary, be and is hereby authorized from the Recreation and Parks Voted Bond Fund No. 702, Department 51-01, as follows:

SECTION 4.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
SECTION 5.   That the monies in the foregoing Section 3 shall be paid upon order of the Director of Recreation and Parks, and that no order shall be drawn or monies paid except by voucher, the form of which shall be approved by the City Auditor.
 SECTION 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 SECTION 7.   That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or 10 days after passage if the Mayor neither approves nor vetoes the same.
