Explanation
1. Background
Pulte Homes of Ohio LLC, by and through Mathew J. Callahan, Division Vice President, owner of the platted land, has submitted the plat titled “Sugar Farms Section 5” to the City Engineer’s Office for review and approval. This plat has been reviewed and approved by the City Engineer. The following ordinance allows the City to accept said plat for property located for a subdivision of lots numbered 229 to 300 both inclusive and reserves “J”, “K” and “L”.
2. Fiscal Impact
There is no fiscal impact to the City to accept the plat.
3. Emergency Justification
Emergency action is requested to complete the required transfer so that construction may proceed and be completed within the current construction season.

WHEREAS, the plat titled “Sugar Farms Section 5” (hereinafter “plat”) has been submitted to the City Engineer’s Office for approval and acceptance; and
WHEREAS, Pulte Homes of Ohio LLC by Mathew J. Callahan, Division Vice President, owner of the platted land, desires to dedicate to the public use all or such parts of the avenues and easements shown on said plat and not heretofore so dedicated; and
WHEREAS, after examination, it has been found to be in the best interest of the City to accept said plat; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that said plat should be accepted immediately to allow new development in the area of Sugar Farms Section 5 to proceed as quickly as possible, to ensure the safety of the traveling public thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
SECTION 1. That the plat titled “Sugar Farms Section 5” on file in the office of the City Engineer, Division of Design and Construction, be and the same is hereby accepted.
SECTION 2. That for the reasons stated in the preamble hereto, which is made a part hereof, this ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
