Title: To authorize the Finance and Management Director to modify a contract on behalf of the Office of Construction Management with Capital City Electric, LLC. for the renovation of energy efficient interior lighting for the apparatus bay interior of Fire Station No. 13, 309 Arcadia Avenue; to authorize the expenditure of $74,166.00 from the Energy Efficiency and Conservation Block Grants (EECBG) Program; and to repeal Ordinance 0361-2012, passed March 5, 2012; and to declare an emergency. Explanation
 
BACKGROUND:  This legislation authorizes the Finance and Management Director to modify and increase a contract on behalf of the Office of Construction Management with Capital City Electric, LLC. for the purpose of conducting energy efficient interior lighting renovations on Fire Station, No. 13 at 309 Arcadia Avenue. This ordinance also repeals Ordinance 0361-2012, passed March 5, 2012.  
Utilizing federal monies from the Energy Efficiency and Conservation Block Grant Program (EECBG) the City of Columbus has been able to retrofit nearly 26 Columbus Fire Stations with energy efficient lighting, occupancy sensors and controls. When the retrofit project began, monies for the completion of all of the Stations was not fully identified so the renovations took place in stages through various contract modifications. When the legislation for the 26th Fire Station monies were not available within the EECBG program so local funding was identified. Since then due to under runs and final quantity estimates from a Department of Public Service pedestrian safety project monies to fully fund these improvements are now available. Therefore, this ordinance repeals ordinance 0361-2012 and essentially reauthorizes the same contract modification, but utilizes funding from the EECBG.
 
Emergency action is requested so the final renovations can be completed and the city can quickly benefit from the reductions in energy usage and associated costs.
Capital City Electric, LLC. Contract Compliance No. 76-0774593; expiration date September 9, 2012.
 
Fiscal Impact:  The total cost of this contract is, including modifications, is $2,482,473.00. Funding for this modification will be from the Energy Efficiency and Conservation Block Grants (EECBG) Program, under the American Recovery and Reinvestment Act (ARRA) of 2009, which represents a Presidential priority to deploy the cheapest, cleanest, and most reliable energy technologies available - energy efficiency and conservation - across the country.

WHEREAS, Ordinance No. 1667-2010, passed December 9, 2010, authorized the original contract for renovation of energy efficient interior lighting for the City of Columbus fire stations, the contract was modified by Ordinance No. 0547-2011, passed March 13, 20011 and by Ordinance 0897-2011, passed June 23, 2011; and
 
WHEREAS, it is necessary to repeal Ordinance No. 0361-2012 and to reauthorize the Director of Finance and Management to  modify the contract for renovation of energy efficient interior lighting for the apparatus bay interior of Fire Station No. 13, 309 Arcadia Avenue; and
 
WHEREAS, an emergency exists in the usual daily operation of the Finance and Management Department, Office of Construction Management, in that it is immediately necessary to modify a contract with Capital City Electric, LLC. for the renovation of energy efficient interior lighting apparatus bay lighting for Fire Station No. 13, 309 Arcadia Avenue and to repeal Ordinance 0361-2012, passed March 5, 2012, so that the renovations to be undertaken can begin as soon as possible; thereby preserving the public health, peace, property, safety and welfare; now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Finance and Management Director is authorized to modify a contract on behalf of the Office of Construction Management with Capital City Electric, LLC. for the renovation of energy efficient interior lighting for the apparatus bay at Fire Station No. 13, 309 Arcadia Avenue.
 
SECTION 2.  That the Auditor's Office is hereby authorized to transfer appropriations of $74,166.00, within fund 220; grant number 459106, Dept. 45-50 as follows:

SECTION 3. That the expenditure of $74,166.00, or so much thereof that may be necessary in regard to the action authorized in SECTION 2, be and is hereby authorized and approved to be expended from the Department of Finance and Management, Department:  45-01, Fund 220,Grant Number 459106, Object Level One 06, Object Level Three 6625, OCA Code 459110.
 
SECTION 4. That Ordinance 0361-2012, passed March 5, 2012, is hereby repealed.  
 
SECTION 5.  That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten day after passage if the Mayor neither approves nor vetoes the same.
