Explanation
BACKGROUND: This ordinance authorizes the Director of the Department of Development to enter into a contract with The Shining Company, a Certified Emerging Minority Business Enterprise Company, (cc# 31-130-3398, expires Feb. 12, 2010) to provide grass cutting service on City-owned property being held in the Land Bank. The Shining Company was the sole respondent to a request for bids (2008 SA001851) and were selected based on lowest bid and prior experience. Grass cutting services were started under an initial contract for $16,000 in order to maintain undeveloped lots and vacant structures held in the Land Bank until such time legislation can be prepared and accepted.
FISCAL IMPACT: Funds for this contract are allocated from the General Fund ($20,000) and the Land Management Fund ($20,000).
EMERGENCY JUSTIFICATION: Emergency action is requested for the uninterrupted continuation of grass cutting services in the neighborhoods.

WHEREAS, this ordinance authorizes the Director of the Department of Development to enter into a contract with The Shining Company to provide grass cutting services for the Land Redevelopment Office; and
WHEREAS, an initial contract was established for the amount of $16,000 to allow grass cutting services to continue uninterrupted through the current mowing season; and
WHEREAS, The Shining Company was the sole respondent to a request for bids (2008 SA001851) and were selected based on lowest bid and prior experience; and
WHEREAS, The Shining Company is a Certified Emerging Minority Business Enterprise company with Equal Business Opportunity Commission Office; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Development in that it is immediately necessary to enter into contract with The Shining Company to continue grass cutting services uninterrupted, all for the preservation of the public health, peace, property, safety and welfare; and NOW THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of the Department of Development is hereby authorized to enter into contract with The Shining Company to provide grass cutting services to the Land Redevelopment Office for parcels held in the Land Bank.
Section 2. That for the purpose stated in Section 1, the expenditure of $20,000 or so much thereof as may be necessary, be and is hereby authorized to be expended from the Department of Development, General Fund, Fund 010, Division 44-01, Object Level One 03, Object Level Three 3354, OCA Code 440311.
Section 3. That for the purpose stated in Section 1, the expenditure of $20,000 or so much thereof as may be necessary, be and is hereby authorized to be expended from the Department of Development, Land Management Fund, Fund 206, Division No.44-01, Object Level One 03, Object Level Three 3354, OCA Code 441206.
Section 4. That this contract is awarded in accordance with Chapter 329.11 of the Columbus City Codes, 1959.
Section 5. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
