Explanation
Background: The City owns property adjacent to 4500 Dublin Road that is part of the Scioto River watershed [Franklin County Tax Parcel 560-196707]. 58 Partners Foundation Church, the Owner of 4500 Dublin Road, [Franklin County Tax Parcel 200-000272] has several encroachments on the City’s property including stone steps, a stone walkway, a stone wall, a deck, and a spiral staircase. These encroachments, that have existed since at least 1947, have historically been addressed through an encroachment easement. The Department of Public Utilities, Division of Watershed Management (“DPU”) has been working to eliminate encroachment easements through either the removal of the encroachment or, in situations such as this where removal would be nearly impossible or cause significant damage to the abutting property, engage in a land swap. In this case the exchange of land will be a 0 .017 acre split from the City’s parcel, parcel number 560-196707, exchanged for a 0.017 acre split from 58 Partners Foundation Church’s parcel, parcel number 200-000272, commonly known as 4500 Dublin Road.
DPU, in consultation with the Recreation and Parks Department and the Department of Development, has determined that the exchange of property is in the best interest of the City and should be done at no monetary cost. Therefore, the following legislation authorizes the City’s director of the Department of Development, with approval from the directors of the Department of Public Utilities and the Recreation and Parks Department, to execute those documents, as approved by the Columbus City Attorney, Real Estate Division, to transfer a 0.017 acre portion of the City’s property to 58 Partners Foundation Church in exchange for 58 Partners Foundation Church transferring a 0.017 acre portion of their property to the city.

To authorize the director of the Department of Development, with the approval of the directors of the Department of Public Utilities and Recreation and Parks Department, to execute all documents. as approved by the Columbus City Attorney, to engage in an exchange of 0.017 acres of property with 58 Partners Foundation Church. WHEREAS, the City desires to transfer a 0.017 acre portion of City-owned real property located in the vicinity of 4500 Dublin Road Columbus, Ohio 43221 [Franklin County Tax Parcel 560-196707] (“Property”) to 58 Partners Foundation Church; and
WHEREAS, in exchange for the 0.017 acre parcel, 58 Partners Foundation Church will transfer a 0.017 acre parcel of real property owned by them and located at 4500 Dublin Road Columbus, Ohio 43221 [Franklin County Tax Parcel 200-000272] to the City; and
WHEREAS, it has become necessary in the usual daily operation the City’s Department of Public Utilities, in consultation with the Recreation and Parks Department and the Department of Development, determined that the property exchange was in the best interest of the city and should be transferred at no cost; and now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the director of the Department of Development, with approval from the directors of the Department of Public Utilities and the Recreation and Parks Department be, and hereby is, authorized to execute those documents necessary to transfer, via quitclaim deed, a 0.017 acre parcel described and depicted in the Two (2) page attachment Exhibit A, which is fully incorporated for reference as if rewritten, located in the vicinity of 4500 Dublin Road Columbus, Ohio 432221 [Franklin County Tax Parcel 560-196707] to 58 Partners Foundation Church and, in exchange, to accept from 58 Partners Foundation Church a 0.017 acre parcel described and depicted in the Two (2) page attachment Exhibit B, which is fully incorporated for reference as if rewritten, located at 4500 Dublin Road Columbus, Ohio 432221 [Franklin County Tax Parcel 200-000272] that is being deeded to the city. The 0.017 acre parcel deeded to the City is to be combined with the City’s adjacent parcel 560-196707.
SECTION 2. That the City Attorney’s Office, Real Estate Division is required to approve all instrument(s), associated with this ordinance.
SECTION 3. That the exchange of property be done at no monetary cost.
SECTION 4. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
