Council Variance Application: CV26-005

 

APPLICANT: Prime Construction, LLC, c/o Jarrett Fuller; 3840 Lacon Road, Suite 5; Columbus, OH 43026.

 

PROPOSED USE: Beauty salon.

 

CLINTONVILLE AREA COMMISSION RECOMMENDATION: Approval.

                                                                               

CITY DEPARTMENTS' RECOMMENDATION: Approval. The site consists of one parcel developed with a single-unit dwelling in the SR, Suburban Residential District. The requested Council variance will allow a 603 square foot addition above the existing garage to be used as a beauty salon. A Council variance is required because commercial uses are not allowed in the SR district. Included in the request is a variance to reduce required parking from five to two spaces. The site is within the planning boundaries of the Clintonville Neighborhood Plan (2009), which recommends “Single Family” land uses at this location. Since the proposed use will only service one client at a time, and is an accessory use to the single unit dwelling, the requested use is consistent with the land use plan, and will not introduce an incompatible use to the area.

To grant a Variance from the provisions of Sections 3332.029, SR suburban residential district; and 3312.49(C), Required parking, of the Columbus City Codes; for the property located at 430 E. KANAWHA AVE. (43214), to allow a beauty salon with reduced parking in the SR, Suburban Residential District (Council Variance #CV26-005).

 

Body

 

WHEREAS, by application #CV26-005, the owner of the property at 430 E. KANAWHA AVE. (43214), is requesting a Variance to allow a beauty salon with reduced parking in the SR, Suburban Residential District; and

 

WHEREAS, Section 3332.029, SR suburban residential district, does not allow commercial uses, while the applicant proposes to build a 603 square foot addition above the existing garage for use as a beauty salon; and 

 

WHEREAS, Section 3312.49(C), Required parking, requires two parking spaces per dwelling-unit and one parking space per 250 square feet of salon, a total of five spaces for the existing dwelling unit and proposed salon, while the applicant proposes two total parking spaces; and

 

WHEREAS, the Clintonville Area Commission recommends approval; and

 

WHEREAS, the City Departments recommend approval of the requested variances because the proposed use is accessory to the existing single unit dwelling, and remains consistent with the Clintonville Neighborhood Plan; and

 

WHEREAS, said ordinance requires separate submission for all applicable permits and Certificate of Occupancy for the proposed beauty salon; and

 

WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and

 

WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent properties or unreasonably increase the congestion of public streets, or unreasonably diminish or impair established property values within the surrounding area, or otherwise impair the public health, safety, comfort, morals, or welfare of the inhabitants of the City of Columbus; and

  

WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owners of the property located at 430 E. KANAWHA AVE. (43214), in using said property as desired; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That a variance is hereby granted from the provisions of Sections 3332.029, SR suburban residential district; and 3312.49(C), Required parking, of the Columbus City Codes, is hereby granted for the property located at 430 E. KANAWHA AVE. (43214), insofar as said sections prohibit a 603 square foot beauty salon in the SR, Suburban Residential District, with a parking reduction from five required spaces to two spaces; said property being more particularly described as follows:

 

430 E. KANAWHA AVE. (43214), being 0.62± acres located at the northwest corner of East Kanawha Avenue and Rush Avenue, and being more particularly described as follows:

 

Situated in the State of Ohio, County of Franklin, and City of Columbus being bounded and further described as follows:

 

Being Lot Number One Hundred Eight-four (184) of Sharon Heights Page: 3 of 3 CV26-005 Addition, as the same Is numbered and delineated upon the recorded plat thereof, of record in Plat Book 10, page 76, Recorder's Office, Franklin County, Ohio, Excepting therefrom the following: thirty (30) feet off the west side of said Lot No. 184.

 

SECTION 2.  That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for a 603 square foot beauty salon as an accessory use to a single-unit dwelling, or those uses allowed in the SR, Suburban Residential District.

 

SECTION 3.  That this ordinance is further conditioned on the subject site being developed in general conformance with the site plan titled, "SITE PLAN,” dated April 7, 2026, and signed by Jessica Steiner, agent for the Applicant. The plan may be slightly adjusted to reflect engineering, topographical, or other site data developed at the time of the development and when engineering and architectural drawings are completed. Any slight adjustments to the plans shall be subject to review and approval by the Director of the Department Building and Zoning Services, or a designee, upon submission of the appropriate data regarding the proposed adjustment.

 

SECTION 4. That this ordinance is further conditioned on the applicant obtaining all applicable permits and a Certificate of Occupancy for the proposed beauty salon.

 

SECTION 5.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
