BACKGROUND: On February 13, 2004, LVR, Inc. purchased property leased by the Public Service Department, Facilities Management Division, for use by the Public Safety Department. The previous owner was All Star Limited Partnership. This ordinance authorizes the assignment of all present and future business done by the City of Columbus relating to lease agreement CT17850 with All Star Limited Partnership, FIN 31-1310229, to LVR, Inc., FIN 31-1212072. The balance of purchase order DL005782 of $71,250.00, which was approved by City Council on July 28, 2003 by Ordinance #1657-03, Certificate AC 020772, must be assigned to LVR, Inc. Furthermore, the authority to enter into contract with All Star Limited Partnership for the new lease period beginning August 1, 2004 through July 31, 2005, which was approved by City Council on March 9, 2004 by Ordinance #0288-04, Certificate AC022175, must be assigned to LVR, Inc.
Emergency Action: Emergency action is requested so that LVR, Inc. may be paid in a timely fashion. The next rental payment is due on May 1, 2004.
Fiscal Impact: No additional funds are needed for this assignment.

WHEREAS, the Public Service Department, Facilities Management Division contracts with All Star Limited Partnership for leased property used by the Public Safety Department, and
WHEREAS, All Star Limited Partnership, FIN 31-1310229, has sold the leased property to LVR, Inc., FIN 31-1212072, and
WHEREAS, in order for the Public Service Department, Facilities Management Division to pay the new property owner at the time payment is due, it is necessary to assign all present and future business relating to lease agreement CT17850 with All Star Limited Partnership to LVR, Inc., including the balance of $71,250 encumbered on purchase order DL005782, and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Facilities Management Division, in that it is immediately necessary to authorize the Public Service Director to make such an assignment, so that rent payments are properly made for this space used by the Public Safety Department, thereby preserving the public health, peace, property, safety, and welfare; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Public Service Director be and is hereby authorized to assign to LVR, Inc., all present and future City business relating to lease agreement CT17850 with All Star Limited Partnership and execute all documents necessary thereto.
SECTION 2. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
