Title: To accept an easement from the Ohio Power Company, an Ohio corporation, and authorize the Director of the Department of Public Utilities execute a Quitclaim Deed of Easement unto the Ohio Power Company, for the installation of a Gas Insulated Switchgear and the transmission of electricity to that City owned real property commonly known as the First Avenue Substation (Italian Village) and to declare an emergency.

Explanation
In June of 2007, the City of Columbus and the Ohio Power Company, an Ohio corporation ("AEP"), entered into an Interconnection and Local Delivery Service Agreement ("Service Agreement") to establish the terms and conditions of AEP's local transmission, delivery and sale of local electric power and energy to the City.  As part of the Service Agreement, the City agrees to accept an easement from AEP and grant an Quitclaim Deed of Easement to AEP necessary for the installation of a Gas Insulated Switchgear and the transmission of electricity to that City owned real property commonly known as the First Avenue Substation (Italian Village), located in the vicinity of 1st Avenue and Waldron Street.  The Department of Public Utilities has determined that the electrical service provided by AEP will benefit the City, and that it is in the best interest of the City to grant the easement at no charge in exchange for the easement from AEP. The following legislation authorizes the Director of the Department of Public Utilities to execute a Quitclaim Deed of Easement to AEP and accepts an easement from AEP on behalf of the City.
Fiscal Impact:  N/A
Emergency Justification:  Emergency action is requested as not to delay the benefit to the City, which will result from the construction, maintenance and installation of the electric equipment.

WHEREAS,  in June of 2007, the City of Columbus and the Ohio Power Company, an Ohio corporation ("AEP"), entered into an Interconnection and Local Delivery Service Agreement ("Service Agreement") to establish the terms and conditions of AEP's local transmission, delivery and sale of local electric power and energy to the City, as pursuant to Ordinance 0904-2007; and
WHEREAS,  as part of the Service Agreement, the City agrees to accept an easement from AEP and grant an Quitclaim Deed of Easement to AEP necessary for the installation of a Gas Insulated Switchgear and the transmission of electricity to that City owned real property commonly known as the First Avenue Substation (Italian Village), located in the vicinity of 1st Avenue and Waldron Street; and
 
WHEREAS,  the Department of Public Utilities has determined that the electrical service provided by AEP will benefit the City, and that it is in the best interest of the City to grant the easement at no charge in exchange change for the easement to the City; and
WHEREAS, an emergency exists in the usual daily operation of the City in that it is immediately necessary to accept an easement from the AEP, and authorize the Director of the Department of Public Utilities execute a Quitclaim Deed of Easement unto the power company, for the installation of a Gas Insulated Switchgear and the transmission of electricity to that City owned real property commonly known as the First Avenue Substation (Italian Village), thereby preserving the public health, peace, property, safety, and welfare; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of the Department of Public Utilities be and hereby is authorized to execute a Quitclaim Deed of Easement, as approved by the Columbus City Attorney, Division of Real Estate, necessary to quitclaim unto the Ohio Power Company a perpetual non-exclusive easement, in, over, under, across and through the following described real property, for the purpose of providing electric service to the First Avenue Substation (Italian Village):

Section 2.  That the City of Columbus hereby accepts an easement from the Ohio Power Company in, over, under, across and through the following described real property for the purpose of providing electric service to the First Avenue Substation (Italian Village):

Section 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
