Background: Three bids were received by the Recreation and Parks Department on April 1, 2008 for the Pool Facility Painting Improvements Project, as follows:

Fiscal Impact: $40,000.00 is budgeted in the 1999/2004 Recreation and Parks Bond Fund, Swimming Facility Improvements, for this project, which includes a contingency in the amount of $5,600.00.
Emergency action is requested so the project can begin immediately to allow for its completion prior to the start of the summer pool season.

To authorize and direct the Director of Recreation and Parks to enter into contract with Kastra Painting, Inc. for the Pool Facility Painting Improvements, to amend the 2007 Capital Improvement Budget, to authorize the expenditure of $40,000.00 from the Voted 1999/2004 Recreation and Parks Bond Fund, and to declare an emergency. Body
WHEREAS, the Recreation and Parks Department desires to enter into contract with Kastra Painting, Inc. for the Pool Facility Painting Improvements project; and
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to enter into contract with Kastra Painting, Inc. so the project can begin immediately to allow completion prior to the summer pool season; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of Recreation and Parks be and he is hereby authorized and directed to enter into contract with Kastra Painting, Inc. for the Pool Facility Painting Improvements project in accordance with plans and specifications on file in the Recreation and Parks Department.
Section 2. That the expenditure of $40,000.00 or so much thereof as may be necessary, be and is hereby authorized from the Voted 1999/2004 Parks and Recreation Bond Fund No. 702, Dept. 51-01, as follows, to pay the cost thereof.

Section 3. That the 2007 Capital Improvement Budget Ordinance No. 0733-2007 is hereby amended as follows in order to provide sufficient budget authority for previously approved legislation:

Section 4. That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
Section 5. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this legislation.
Section 6. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
